DRP letter, never recieved PNC and have NEVER parked where they are alleging

HI

So I received a letter today from DRP saying I owe £160 for an unpaid PNC from JD Parking Consultants and I almost bawled. However I then looked at the location and determined,
1. I have NEVER parked there in my life and
2. That I was at work on the day in question, miles away from the place.

I therefore obviously never got a PNC attached to my car, I had however changed address around 6 months ago and forgotten to pay my road tax......which I have now sorted and just had to pay a penalty for, so i’m wondering if original PNC was delivered to my old address.


Anyway, I’ve read the sticky threads and have decided to ignore the DRP ding dongs as reccomended.
However I am wondering how this has happened as I definitely haven’t parked where they claim!
Everyone’s else’s threads that i’ve read seem to be saying that they had done as stated in their PNC’s but had just decided to ignore the fine for whatever reason and that DRP getting in touch was the result.
As that isn’t the case here i’m wondering whether I should get in touch with JD Parking Consultants and explain that they must have made a mistake to try and stop any further letters?

    You could try a SAR to JD Parking asking for all and any evidence they have that you parked there on that date.

    Have you read Schedule 4 of the Protection of Freedoms Act?

    In certain circumstances Registered Keepers of vehicles may be responsible for these charges, even if they were not driving. Did you allow someone else to drive your car that day?

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    No one but me has access to my car. I haven’t lent it to anyone. And I definitely didn’t park in the stated location on that or any other day.
    I’m not sure until I get back to work to check what I was actually doing that day but it may well have just sat in my works car park all day.
    I feel like it must be a mistake in terms of number plate identity.

    My best guess would be a plate misread. It's not uncommon. Either a human putting in a dodgy digit or a camera with a shaky shot.

    If it was ANPR they often "enhance" the image to identify the plate. The so called enhancement often leads to all sorts of problems.

    If you have a smart phone then you/it should hae some sort of location tracking, most commonly through somethi glike google maps/timeline.


    If you can find out whos car park it was/is as it would/could be helpful to disclose the car park information+location on here, then you should go full bore at the landowner ( depending who the land owner is)


    Dear JD parking, Re parking ccharge notice #### / debt recovery plus notice #### you are harrasing me for something that i do not owe, for your infomraiton my vehicle was not in the location you aledge, it was, and youe systems are clearly defective, for the avoidance of doubt i have enclosed a google maps tracking info/screenshot/data of the day in question.
    You must now cease processing my data, as it is clearly inacurate.
    I also expet a full and un redacted appology from you as a result of your poor data handling/processing, a complaint will be made to the Information comissioners office over this breach of the GDPR regulations.
    other than your personal appology, and a confirmation that this mattter is now closed, you must cease contacting me on this mattter, and remove my details from your systems.


    Wait to see what they cme up with, if they continue to pursue/ignore, or say its ow with DRP complain again to the ICO, and follow up with a complaint to the landowner somthing like...





    Dear landowner, on DATE, your agents, JD parking through Debt recovery plus have started to prsue and harrass me for so called parking charge notice, that neither myself, or my vehile could have been responsible for, pakring charge reference ###

    Under Section 5 of the General Data Protection Regulations (GDPR) you, and your agets are responsible for keeping up to data and acurate data with regards to the processing of personal data.
    As my vehicle was not on that site on that date your agents, JD parking have processed my personal data with out due care and attention, and have faile to take every reasonable step to ensure that my personal data was gathered acurately.
    I am sure you are aware of the GDPR 'regulations' at this time, and the consequencies of breaching them, as well as the fact that you are jointly and severaly liable for their actions .
    Other than a confirmation that this matter is now closed and a full appology i exect to hear no more from your agents with regards to pursuing this matter
