QDR & Apcoa Parking Question

Hi All,


I am new to the forum so apologies if this question is already answered else where.


My girlfriend received a PCN from Apcoa parking at Luton Airport. The letter arrived dated 23 August 18 for an alleged contravention which occurred on 5th Augist 2018. The Letter included 4 pictures of the vehicle taken over a 10 second timeframe. A passenger is visible but they are from the rear and the driver is not visible in the pictures.


She has ignored this notice and a subsequent reminder from Apcoa. She has received a Debt Collection notice from ZZPS and a final reminder from the same, which she has also ignored.


She has now received a letter from QDR. This states failure to pay may result in them passing the matter to the litigation team and they may seek CCJ.


Everything I read suggests I should continue to ignore this. However, I am starting to have doubts.


Please can some reassure that this is the best course, or should I engage with them?

    At this stage the keeper should ignore everything except either a Letter of Claim or official court correspondence.

    That letter from QDR is not a Letter of Claim.

    ZZPS are time wasting idiots to ignore completely

    With QDR, the clue is the word "MAY"

    They have many hoops to jump through and the first being a Letter Before Claim proving their claim and giving you 30 days to respond

    QDR are a cheapo offshoot of the disgraced Wright Hassall solicitors.

    Just ignore until you get a letter before claim, if that ever comes

    Had the initial notice and/or reminder not been ignored, it would have been an easy POPLA win for your gf. It would have been dead and buried.

    Instead, and now too late for POPLA, it will be 6 years before you can say this is over. That's the statutory limit that APCOA have to pursue through the courts. Whether they will or won't - there are no guarantees. At the moment, they don't, but they have to 2024 to alter their behaviour.

    Think this reassures me, and we'll wait and see if a Letter Before Calim ever arrives.
    Just a thought for if and when it does come, what are the key things that will make an actual "Letter Before Claim" disguishable from all the "correspondance" she is recieving?

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    It will be delivered by a flying pig!

    It will give 30 days for response and enclose a sheaf of forms for completion - but we do not advise completion of those.
