final notice letter

Hello,

I have read through many post on here and think I will be okay to start a thread on this?
The driver received a 'Final notice' letter today from BW Legal giving 16 days to respond.
I'm feeling so stressed by this and wondering if it's easier to just pay the money (which I dont have in December!).
The driver purchased a ticket but on return it had flipped over and hence a PCN was issued. The driver immediately appealed to PPS but this was refused due to them not having enough information.
I have correspondence and the purchased ticket.
The driver has already admitted who was driving back in 2016 in the initial appeal.

Please help as I just want this to go away but also am determined for justice to be done.

Is there a letter format I should send to them about please?

That's now three threads about this incident.

Your question has already been answered on both your other threads..

Are you reading the replies you are getting?
  • Thank you. Yes I am reading the replies but they conflict with the various other advice. Some say treat a final notice as a LBC and others say ignore. Its not easy to get clarity to be honest.

Sorry, but I can see no conflict.

On your first thread, beamerguy asked
4: does the letter give you 30 days to respond
    You didn't answer until today.

On that same thread, over two weeks ago nosferatu1001 asked:
...does it state they WILL commence court proceedings, and does it give a 30 or 16 day deadline?
Again, you didn't answer until today.

Now we have seen your answer to those questions, within minutes of you posting it beamerguy answered your original question.
  • Well, thank you for taking time to highlight that I apparently hadnt answered questions from 2 weeks ago, I thought I did. I am still none wiser as to whether to respond to this final notice and how. I have spent all day on here and the only responses that I have had are conflicting 'ignore' from one post and 'treat as a LBC' from another. Is this site purposefully confusing? Reading through many many posts today and replies which almost always refer to a sticky post 2 which is years old or unrelated. I have wasted all day in here and received nothing but a headache and unhelpful, patronizing replies from people who seem to know it all but are reluctant to give personal advice. I think Im gonna end up paying it. Excuse my rant but it's easy for people who aren't in the same situation to trivialize the stress and anxiety this situation evokes. Patronizing replies which tell you to look somewhere else or conflict other are very unhelpful.

we dont give personal advice on here, we give general advice only

the thread and post you want is the third thread down from the top of this forum, written by coupon mad , then scroll DOWN past the end of the first post to post number two , which has a #2 on the top right of the post

(my post here is post #6 if you look to your right)

then read stuff in there and any links etc

how many days did they give you to respond ? (I have no idea)

if it was say 16 days it can be IGNORED, but send a SAR to the DPO at the PPC anyway

if it was 30 days, you do the SAR to the PPC and send an LBC rebuttal to whoever sent you the LBC (also known as an LOC, LBCCC etc - all the same thing)

also, if it was 30 days , do not fill in their financial forms that they included with the 30 days notice LBC

please stick to one thread, having several threads doesnt help your case, it hinders it

pm a board guide and ask them to merge them into one continuous thread

When you read the NEWBIES thread, did you not see this:
Q - ''Is this info up to date, because this thread was started in 2013?''

A - YES, IT IS. SEE THE DATE LAST EDITED IN 2018 AS SHOWN AT THE BOTTOM OF THIS POST.

Post two on that thread was last updated less than a month ago:

It is unfortunate that you had a letter giving you sixteen days to respond and left it fifteen days before [STRIKE]panicking[/STRIKE] realising you perhaps needed to do something.
  • I can see nothing to my right only grey, and the only #2 post I see is written in 2014 which other advice on here tells me to ignore as it is dated and the rules have changed since then . I give up!

The regulars here can only go on the information given. If we don't have all the pertinent information then you are only going to get generic advice based on reasonable assumptions.

Usually the advice given when information is lacking will be the "safest" course of action. It will be the most risk adverse options.

Once information is forthcoming then that advice may change based on more accurate information.
  • The letter which I received two weeks ago did not give me 16 days, I was told to ignore that letter untill I received the LBC. The letter I received TODAY gave me 16 days. So thanks again for the patronizing replies.

that is the correct thread and the post #2 was STARTED in 2014 and been edited and updated numerous times since then , the last time it was edited is recently in 2018

it is the correct one to read and the info it contains is correct

think of it as like a 5 year old blackboard (new 5 years ago), which has been dusted and written on hundreds of times

dont bother reading other threads from 2017, or earlier than 2018, but DO read that post number #2 (it has hashtag 2 on the right at the top of that post, not as far as the grey area , look about two thirds to the right , in the top header of the post)

this post is now post #11 on this thread

    you give up too easily
