The original claim (if set-aside) will not be heard on the same day.
@Just Di - it would in our local court in an attempt to save costs as the defendant resides out of jurisdiction.

Having said that, the OP's application as shown on here would have little chance of success anyway.

OP - do you actually know what the debt relates to? The way that 2.2 is worded makes it sound like you do and you're just trying to use the fact that the claim has been filed by a debt collector as an attempt to get out of paying.

I didn't have to 'update any creditors when I left' as I didn't have any.
I am not applying for a credit card, 'credit arrangement' is the wrong term.

Thank you for all the assumptions.
  • how much longer do you intend living in portugal

Are you coming on holiday? At the moment I am in Thailand, so my house is empty ;)
  • the reason I asked if you were returning , is the fact that the ccj is now one yr old , and only has 5 more yrs to stay active and show on UK credit file
if you intend to stay abroad , for the next 5 yrs , then forget about it

Hi I understand it is a debt collection agency called Cabot.
The house I left in the UK was rented and the judgement was served there in 2017.
This year I bought a house in the UK as well which I was at briefly and so had my bank, council tax and all other such things there registered.

    Thanks
