Does a charging order have to be served in person?

  • It would be issued by a court, at which you would probably want to attend, but it could be issued in your absence.

    Thank you. I don't live at the property I own, and I don't receive post there. I live abroad. How would I know if a charging order had been applied for please?
  • Get someone to check your post to see if they have applied for one.

    If it's already been determined, it will be on Land Registry.

    Oh, I don't receive any post in the UK now. - I only lived at my UK address briefly, I didn't really receive much post there as I only lived there for a few months. The UK address is registered on my credit file.

    My UK house is also registered to me at the Land Registry at my Portuguese address. Would they have to contact me there before applying for a charging order?

    Pay your debts and stop trying to wrangle you way out on "technicalities" that don't exist.

    ? Actually I am applying for a set aside, as I have only just found out the debt exists and I dispute it, and was not at the previous address where the CCJ was issued for over a year.
    Perhaps review your hard attitude and manner that you are correct whilst dealing with vulnerable people.

    Depending on the body, you will probably know that the civil service can be quite officious and posting a letter to Portugal is probably one of these things they might get funny about.

    It was served to your last known address.

    It's not up to your creditors to find out where you live, especially when you've moved to a foreign country.

    What reason do you have to set the order aside other than them issuing notice to an old address?
