    Only mention of costs are that if claimant fails to pay trial hearing by X date the claim will be 'struck out' and they 'will be liable for the costs which the defendant has incurred.'

    Is that not an avenue or have I mistaken that for something else?
    It's good to see that sentence, gives you hope that you can at least write in with a copy of that Order when the C runs away bleating, and ask for your costs...

    Judges are always inconsistent in parking cases except the very good courts like Manchester and Skipton where even a badly prepped defendant fielding no evidence, could win, because the Judges are so switched onto the issues with PPC cases, the POFA, etc.

    I'd say most people on here writing about set asides do not get their £255 back. But that's not a reason not to ask for it and lay all the evidence of 'unreasonableness' on the line, when you next get the chance in your case.
