Hi,
How does the card holder initiate a section 75 claim on his/her credit card?
I'm on the tesco bank website and can't see that section 75 claim form to download.
Can anyone forward me the link to the form or please advise on what's the procedure?

I already tried that and the call waiting times this time of the year are very very long
For Tesco the only way is a phone call? No email, no form downloads or anything quicker in this day and age of the internet?0 -
Are you sure you need to make a S75 claim? Do you have a dispute with a retailer who is in breach of his contract with you? Can you evidence this breach of contract?
If you are in dispute with a retailer you should try to resolve it with them directly and also write to Tesco's disputes team outlining your dispute. You can suggest to Tesco that you believe you have a right to claim from them under S75 of the CCA 1974.
Depending on your dispute, Tesco may be able to initiate a simple Chargeback to the retailer's bankers to resolve the issue.
Don't expect Tesco to just bend over backwards for you when you mention S75; you will need to satisfy them that you have evidence of the breach of contract. If they don't agree with you, and if there is no Chargeback right for them to use either, you may have to take the retailer and/or Tesco to court to have your S75 claim heard.0 -

Chargebacks and section 75 are 2 separate options right? I only paid a qualifying deposit on my credit card not the full amount so even if there was a chargeback I will only just get my deposit back which is not good. Hence my only option is section 75.
Retailer ignoring me and yes I have evidence. Ok what is tesco's dispute team postal address to write to?0 -
Yes, Chargebacks and S75 are not the same and not linked - although an Issuer can potentially use the Chargeback process to recover funds related to a S75 claim (up to the amount of the transactions - as you say).
Try this (it's on their webpages):-
Tesco Bank Credit Card Operations, PO Box 27028, Broadway One, Glasgow, G2 9FT0 -
