Help with UK CAR PARK MANAGEMENTS tickets

Hi,

I was wondering if you could help me. I need some advice on how to handle two parking tickets I’ve received from UK CAR PARK MANAGEMENT Limited.

Driver use to work on an industrial estate with a number of different car parks owned by different companies. Basically this became very full and there was limited space to park.

Driver ended up parking on another companies car park for a few hours. Over two days. Driver received an enveloped letter on my window screen telling me that driver owed them £60 for parking on the property. Driver dismissed the letters as they were not full parking ticketst.driver moved the car after my company told me someone has complained. What driver didn’t know until later is the woman on reception gave the many personal details. There for they had my address and was able to send me a letter through the post.

These letters didn’t seem official either so I never got in touch with the company. Now Gladstone has been in touch and have sent me a claims form. I don’t know how to handle this.. or if it’s possible to fight. They are requesting +£300

Any help would be great.

    maybe she did, maybe she didnt, if she did it was a breach of the DPA in my opinion


    on the assumption that she didnt, UK CPM would have obtained keeper details from the DVLA for the VRM plate and sent the keeper the pcn,s in the post


    you can check when these details were accessed with the DVLA by making a request , plus you can send UK CPM DPO a SAR and get all the evidence they have on you


    lastly, this is complicated so you needc to read post #2 of the NEWBIES FAQ sticky thread


    also tell us how many days they gave to reply in the warning letter or letters


    if you have a REAL claim form, it will have come from Northampton CCBC, not from Gladrags

    You need to edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    DVLA SUBJECT ACCESS REQUESTS

    You should email the DVLA and ask which organisations (and for what reason) accessed the registered keeper's data from them between a range of dates which includes the date(s) of the parking incident(s). You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

    SubjectAccess.Requests@dvla.gov.uk

    Even though you email your request, the DVLA will respond via Royal Mail.

    So are you saying that I need to contact the UK CPM and find out what evidence they have on the driver? Will they openly give me this?

    Is there anything else I can do?

    The SAR to UKCPM will be useful for the later stages of the court process (like the Witness Statement).

    Response to a SAR is a legal requirement. Here's a thread which discusses the SAR and GDPR from when it was first introduced earlier this summer.

    Read post 3 of this thread and act on my advice! Do this before you do anything else.

    Send an SAR to the scammers asking for all the data they have concerning The Keeper, including all photos of the alleged event. I think there is a link to a SAR proforma in the NEWBIES.

    Write to the DVLA to ask who and when your personal data was requested from just before the date of the alleged event until now, as advised in post 4 of this thread.

    Read post 2 of the NEWBIES that has a step by step guide to the court process.
    The first step is an AoS.

    Print or write down the acronyms you will find in post 5 of the NEWBIES.

    you have a genuine court claim there, so you need to do the AOS online to double the response time

    you also need to post the DATE OF ISSUE below, plus the full POC , minus any personal info, and also the breakdown of charges and total claimed

    the SAR is to get all UK CPM have on the KEEPER (all their evidence), as they probably do not know who the driver was, not unless you have told them

    and get on a laptop and edit post #1 as you were advised to do earlier, only use the words DRIVER and KEEPER, no "my, ME , MYSELF & I"

    THIS IS NOW SERIOUS, SO YOU HAVE A LOT TO LEARN

    post #2 of the NEWBIES FAQ sticky thread tells you all about this court claim process (the MCOL) - google MCOL if you dont know what that is

    post #5 of that thread tells you what the acronyms mean, please study them as well

    there are plenty of other threads of a similar nature, GLADRAGS, UKCPM, Northampton CCBC etc, so study those too, as long as they are from this year only (so only 2018 court claim threads)

    Driver of vehicle ***** incurred the parking changes on 07/02 & 13/02 for breaching the terms of parking on the land of ***** the claimant claims £320 for parking charges/ damages and indemnity costs if applicable, together with interest of £19.03 pursuant to s69 of the county court act at 8% pa continuing to jougement at o.07 per day.

    So you think I have a case to fight or should I just try and pay the fees?
