Claiming on 10 years builders warranty

Looking for some advice on the above
My builder isn't a member of nhbc so we have a 10 you warranty via what appears to be an insurance company
I've had ongoing issues which the developers and service company won't help me with
There is a leak from the gutters into my flat. Developers says the gutters are full and need cleaning every quarter
Service company disagree and say its the window seal. And will only clean gutters half yearly. And as a result have put our service charge up by 300 a year
No one will fix my issue or even help me get it resolved
This 10 years warranty company have told me to get my own inspection, quote and report and that I will have to pay 1000 excess for each claim
This does not sound right when the defect is clearly there since I moved in a year and a half ago and
I wondered if anyone has any experience with builders that appear to have done everything on the cheap

Has your gutters been cleaned 3 times since you have been there?
I would pay for them to be cleaned myself and see if it improves your situation.
Post up a picture of the window and gutter so we can see if an overflowing gutter can cause your leak.0 -
Is the warranty against structural defects? if so, neither of these things are probably structural defects and therefore you might not have a claim. Have you thought about getting someone independent to give you advice on the issue.
are you in a flat? if the issue relates to the common parts (eg structure of the building), then its likely you would only be liable for a proportion of the charge through your service charge0 -
They been cleaned a few times
Forgot to say the flat is top floor so need scaffolding or a machine to get up to clean them, so that makes the whole thing so difficult for me to resolve on my own
I can post pics. It can't see how to do that, can you advise?0 -

The cover states making good any defect in the design material or workmanship of drainage system which was newly constructed by the builder
Or the necessary costs incurred in repairing, replacing or rectifying any part of the waterproof envelope within the housing unit
I cannot believe that I would be responsible for costs related to work that was clearly not completed correctly. How is this fair. Cowboy builders can basically bodge the whole building and I have to pay to fix it

If you have a flat, then my view, although i havent read your lease, is that you should get your window seals looked at. If they are given a clean bill of health, then you should ask the landlord to remedy the defect, and it will either attempt to claim from the builder or charge you under the service charge.0

But surely as the flat is less than 2 years old this should be repaired by the builder. I've been in constant contact with the developer and service company and either of them will take ownership for getting the work done
If you suggest getting the seal check. I can sort this but do you know who would be the best people to speak to? Just a window fitter or another building company? I have no idea about this stuff as its my first place. Needless to say I'll never buy a flat again0
