Excel parking- 2nd letter threatening court

Hi all,

Firstly, thank you in advance for all your help as registered keeper is finding this all very overwhelming and scary looking through all of the threads on here on excel parking- they now want £160 payment or they said they will take legal actions. There are a lot of old posts so old information and people have different situations to me so registered keeper doesn't know why to do (sorry for rambling)

A 2nd letter from excel parking came in post from ''offence' at the start of September. When first letter was received an appeal to them was logged on their website stating everything that was advised (that template letter etc) - but this was never responded to by them. The registered keeper actually thought as no response was received Excel had decided to leave trying to get this money.

On the appeal the driver etc wasn't mentioned and a screenshot was actually send to them for proof of payment with the appeal. Parking was paid for the correct time so registered keeper is not sure why this notice has come through- maybe a system error. Anyway registered keeper has now received a letter yesterday which they excel have written it was "posted 13th- with a date of 27th to respond by". Registered keeper is now really anxious as they don't even feel like they have enough time to get the right advice to fight this.

I have read that this company doesn't take a lot of people to court as most people just pay the fee at this point. Please can anyone advice what the registered keeper should do as they are now really tempted to just pay this obscene amount of money just to have them off their back!!

    Delete the comments about who paid for parking! Check the rest of your post as well. Only ever refer to The Driver and The Keeper.

    Nobody here will suggest you pay a bunch of scammers.

    What happened when you complained to the landowner?

    Please also complain to your MP.

    Did you take a screenshot, or do you have any other proof of your appeal? I suggest you contact them saying as they haven't responded to your appeal dated XX/YY/ZZ within the IPC CoP, you consider the matter closed.

    wait for the LBC threatening court with 30 days notice and including financial forms , that is the one you rebut, also if you get an MCOL from Northampton CCBC as that needs dealing with too

    its THE DRIVER for what happened on the day

    and THE KEEPER for anything since that day

    people who blab on the internet may as well just empty out their wallet or purse, these companies love the people who blab and will take screenshots, so be careful what info you give out on the net

    Fruitcake- no registered kepper just took a screenshot of when they logged the appeal as they thought this would be enough :( Registered keeper will log another appeal on their website with your advice fruitcake- thanks!

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.
