According to the BBC the pool was at a bar.
I’m guessing the insurers would assume alcohol was involved.

you cannot claim insure and go are a terrible insurance company from one case where the facts are not completely stated.
I have used them as my travel insurance for many years. When i got very sick in NYC, they found me a doctor, pre authorised the appointment and paid for my medication that was needed. I have nothing but good things to say about their help.0 -

Without making any judgement as to the cause of the incident, what must also be borne in mind is that a person has to act reasonably and sensibly in the conditions prevailing. An insurance policy is not there to pick up the costs and consequences regardless. If it was, then we would all share any recklessly incurred costs through higher premiums.
As someone else has stated, personal responsibility and acting sensibly are not unreasonable things to expect. To dive in to an unknown body of water in the dark (ignoring if alcohol was involved) is a pretty silly thing to do by anybody. So, I cannot apportion blame to the insurer if they have acted reasonably and the incident was as a result of plain silly or reckless behaviour. After all, these types of "accident" are not uncommon and anyone with common sense would know not to just throw themselves in to a body of water where the depth is not clearly sufficient.0
