If he doesn't think it's fair don't use it.

    What's his contract say?
  • It's just been changed to say about the 45p a mile. Just seems a bit steep given the HMRC recommended rate for the reverse situation is 45p a mile including fuel. This is 45p a mile on top of paying for private fuel.
  • May be unfair, but it's their van.

Maybe some employees have been taking the micky with the mileage they've clocked up?

His contract can’t be changed without his agreement. Does he have a union.
  • I think the company (which is small) is feeling a bit skint and looking for ways for claw back some dosh from its employees!
  • No union - he does a very specialised job in a very small company,

If he agrees to it, then it's fair. Does the 45p/mile include fuel or is he expected to provide his own fuel too?

Really, it's up to him, his choices are likely:

Refuse the contract change, and hope he can remain employed, or
Agree with the contract change, and either pay the 45p/mile or just not use the van for personal mileage.

Lots of employers don't cover vans for personal use at all.

Or refuse the terms of the contract, remaining employed but surrendering the private use of the van. I'm guessing this is what the firm want.

I would avoid using it for personal use - the HMRC has cracked down on this type of thing and can/should/will tax your other half for the benefit in kind - so by paying the 45p per mile they can record the number of private miles and submit this information to HMRC.
