I will look at getting a copy of upstairs lease. Thanks for the advice. I have got the lease extension deed and it seems to be just standard.
My solicitor at the time did not raise these issues with me.....I have sent questions back to them and the leasehold advisory service so once they come back with their answers I will look at whether I need to appoint another solicitor. Clearly I will need to have a word with the management company too as they are probably not aware of this situation either. I am intending that to be an amicable discussion about the lease and how it is going to be managed going forward.
I get what you are saying that it is unusual but to me I don't feel it is negative. I'd rather get repairs done myself than be charged a fortune by management company and also have to pay for permission to do things like some have to. Recovering costs from upstairs I don't see as a massive problem because the FH will enforce the lease if needed. I think I just need some further advice and a proper chat with the management company as to a way forward....0 -
100% agree on the 'amicable discussion', certainly at first and see how it goes. You could ask for the freehold to be transferred to you, subject to a lease of upstairs, that would be a much better arrangement and fairly normal in a converted house with two flats such as yours.
All the freeholder has of any worth at the moment is the £500 management fee, but you are not going to continue paying that, so he will be left with nothing but a large headache.0
