VCS ignoring driver nomination

Hi,
I am the registered keeper but my wife was the driver of the vehicle. She was on night shifts in November 2017 when she stayed at the hospital accommodation for 3 nights. On the second morning, the permit on the car dashboard was found on the passenger car mat and a pcn was issued. She decided to ignore it as she was adviced to by colleagues.
After receiving a LBC in August 2018, I followed advice on the newbies page to reply promptly. I also sent them a cover letter stating she was the driver, hoping to reset the clock. That was 31.08.18. I replied to the LBC within a week. Unfortunately as it was so long ago, I can’t find proof of postage of that letter. I do have a copy of the reply letter and form.
I have not heard from them until today when I received a letter intending to start court proceedings after 14 days. I have emailed them again with the above facts and a copy of the reply letter and form. Any advice on what else I should do? Thanks so much

send their DPO a SAR by email to the details on their privacy page , from the person they are writing to, whichever of you that is
also complain to the HR at the trust and get them to get it cancelled, which is what should have been done in the first place !!!

With regards to the SAR, will the VCS litigation team ie jake burgess know that I have submitted it and will it delay court action?0 -
no idea, you would have to ask him, we have no special ESP powers , lol
you could send an LBC rebuttal and tell them to suspend it pending the SAR being returned, what they do is their choice to make and anybody that second guesses it would be a fool, as would the fool that listened to that fool

Not too sure why you think this Burgess guy is in a litigation team.
This is not some professional company you are dealing with ?

Thanks so much. I have submitted the SAR via email to their DPO. Contacted the hospital accommodation office but they say VCS parking fines are out of their control and that I need to appeal to VCS directly.
I just don’t get why they are ignoring that it was my wife that was the driver.
I was hoping that the process would be reset and we will be able to settle the fine as this has dragged on so long.0 -
get her to complain to the trust themselves complaining that they are ignoring the NHS principles I told you about, they cannot just wash their hands of it
all this cant and wont is not relevant and hasnt been for a few years
they cannot ignore those guidelines
complain to your MP and get them to write to the trust as well, about the same thing
its the squeaky wheel that gets the oil , so dont allow yourselves to be fobbed off , start doing FOI requests and complaints etc until they take notice, be pro-active, not reactive0 -

This is what happens when you get involved with these scammers, you are not dealing with John Lewis. Complain to your MP.
It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
Just looking back at the first time I received a notice to keeper. Offence date was 6/11/17 and date of the notice was 12/11/17. That’s 6 days. Does that mean it’s not enforceable due to guidelines below:
The Creditor or its agent must have made application to the DVLA for your name and address either
NOT EARLIER than 28 days after the vehicle was parked (where a Notice to Driver was issued); or
NOT LATER than 14 days after the vehicle was parked (where a Notice to Driver was not issued)0 -

BTW, shaking the car to make a permit fall off the dashboard is pretty standard stuff from these PPCs. That's the kind of people you're dealing with.0 -
