    My main defence is that Keeper was not a driver. Are you aware of any case where judge did not agree with this or still accepted Claimant claim?

    Hi,

    If I am not able to attend court hearing then what should I do? Agree settlement with claimant or write to court requesting decide based on witness statement in my absence?

    Are you really definitely unable to spare a couple of hours/half a day off work to save being stuffed for nearly £300 in your absence as you will lose any chance to defend yourself and be heard?

    This is now the most likely outcome as they will send a rep and they will try to lead the Judge.

    My new contract is starting two days before the hearing and if I take half day off then my contract will not start until next day after hearing. I will lose out over £1500 this way.

    But I have requested them again to give me half day so waiting to hear back from them.

    Unfortunately, they have refused to give me half day as they don’t want any interruptions. So I have no option but to skip the hearing.

    Is there any template letter I can send to court and is there anything specific I should write in the letter?

    Is it possible to ask for rescheduling hearing date?

    UPDATE: I couldn’t attend court hearing due to the reason mentioned above. I also couldn’t inform the court either.

    I called their solicitor a day before hearing and asked if they will consider settling before court hearing but they refused. I should not have called them but I wanted to avoid extra cost if I lose in the case but didn’t want to pay amount as per their demand.

    After anxiously waiting for court letter, I finally received judgement today. To my delight, it stated that claimant case is dismissed.

    To be honest, I was not sure if my defence is solid and whether it will stand the scrutiny but I am glad that it did.

    Thanks everyone for your help as it wouldn’t have been possible with your support and guidance.
