Vodaphone! They have lied about free gift.

I took out a contract with Vodaphone on the premise that I was to receive a free gift. I registered on the day as soon as I could for it and entered the code. I then called Vodaphone to see what happens next and they said wait for an email. No email came. I phoned 1 week later and was given a number to TLC. Their number has been busy morning noon and night. I rang Vodaphone and got given another number. Again the same. I kept back and forth between Vodaphone and trying to get through to TLC. Eventually Vodaphone gave me a 3rd number. I got through and they said they had taken me off the system as I didn't respond to the email I never had! How am I supposed to respond to something I didn't receive!? I've done everything I could. They said Vodaphone can put me back on. So again ring Vodaphone who say they can't and its down to TLC. TLC are telling customers it's Vodaphone who can. So they are noe being investigated for not sending out emails but also lying to customers apparently!! So now I'm stuck. Vodaphone have offered £25 good will gesture. No! The free gift was worth £200 and was meant to be a Xmas present for my daughter as I don't have much money. I've said I want to cancel the contract but they won't allow me to without paying the full amount of the contract. I feel I've been lied to by Vodaphone. Had any one else experienced this and is there anything I can do? They can see how many times I've called which a numourous since August! And why do you need another email anyway with another code when you've already registered for the gift. So many hoops to jump through to get something you're promised!

When the things are getting this messy NEVER ring or come in to shop. Only communicate via email so they can't claim in the future you have never contacted them, or raised a certain issue.
From your message I don't understand who TLC are, but your contract is with Vodaphone and your next step is to make a formal complaint to them.0 -
Were there any disclaimers such as "subject to availability" etc?
Maybe they have run out of the free stock?0 -

I had a similar issue with Virgin Media!! They said we would get a Nintendo Switch with a phone contract, but I "failed the credit check" even though my score is 90% perfect, they then offered me some other phone's without the free gift...why would they do that if I failed the credit check :think: I think some companies just want you to sign up anyway and not spend money giving out the gifts as promised. I would cancel everything and not bother with them again!! Write them a horrible email and write bad review.0

In this case the gift certainly isnt free, you would be paying a lot more for the duration of the contract, for an older phone and the "free" gift, than you would be for a newer phone and no gift. Of course, that works out for some people
The company would not be spending money sending you the gift, the cost of the gift is paid for by you over the duration of the contract.0 -

The law states that free gifts are part of the contract. If you make a decision on a contract based on the free gift and wouldn't have entered into this contract without it then it becomes legally binding.
You could hold the contract in breach but they simply won't agree. The only recourse you have is to stop using the contract and take them to court. If you just stop paying they will mess up your credit file and it will be another big hassle getting it corrected so be careful how you handle this.
