Having read with interest CathyCathy's experience and people's most helpful and comforting comments on another thread I thought I'd share my experience of going head-to-head with these people.
I too am at the stage of jousting with BW Legal, whose aim it appears is to extort money by keeping up a barrage of harassment in the expectation that I give up and pay up.... which I won't.
In my case for info, UKPPO alleged an infringement by the driver of my car of Bye Laws, while it stood just before the entry barrier of the Double Tree hotel at Newcastle Airport, but well clear of the yellow box or red lines at that location. From the photo they sent, the rear of its back bumper was even level with the hotel Welcome posts! My appeal was rejected and I wanted the matter to go to Mags court to have the magistrate rule on the law, so soon I began ignoring their letters.
The alleged infringement was in mid-2017 and after the UKPPO and Gladstones threatening letters stopped I thought I'd get my day in court.
Not so. Fast forward to November 2018, when the letters from BW Legal started. They're threatening county court action and inviting me to enter into negotiation about the charges, which magically have now morphed in their eyes into an escalating and ridiculous civil debt. For goodness sake: for a start what happened to the 6 months cut-off for action under bye laws - even if they do apply which, by what I'm reading here, they don't???
I responded to the first two of these letters but nevertheless despite me still challenging the basis of the matter and its chronology of administrative process it appears that the company’s campaign of intimidation and harassment is being ramped up because another letter arrived this week.
I've had encouraging responses from both my MP (and I can't praise him highly enough), and the Secretary of State for Transport’s office, but my next steps are to establish the legality of the whole process from UKPPO contacting the DVLA to BW Legal getting involved, together with SARs and any other FOI requests.
As well as anyone reading this helping me with constructive advice (pretty please!), do you have links by any chance to the wording of your formal requests and to whom they should be sent? The Internet's so awash with forum posts like this, my eyes are snow-blind and I can't see the wood for the trees.

You seem to be more informed than most - the small number of regulars are fighting on so many different fronts involving many elements of consumer/parking law.
You have the (enviable?) option of dealing with a single-track angle of attack. I'm sure if anyone has an opinion to contribute, they will do so, but you can concentrate your efforts in a relatively 'narrow' subject area.
Keep us informed as you garner more knowledge and understanding, and how you (eventually) blow UKPPO and Gladstones into the dust.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Under bye-laws any 'fines' are payable to the courts.
The airport [or the ppc scum] doesn't do that...they keep the money for themselves.
They don't want that bringing up at court....
So write and tell them that [the airport not the ppc scum or scum debt chasers]...and invite them to take you to court.
They will shrivel up and crawl back under the piece of horse turd that they came from...0 -
Please keep us up to date on this. If they are daft enough to try court please consider a counter claim and CPR14.27(2)(g) damages.You never know how far you can go until you go too far.0

Problem is, I don't have limitless time nor the inclination to argue tit for tat with these people until such time as they decide that they've ramped their fees enough to justify taking the case to court. Aren't there any no-win-no-fee lawyers in this field yet, if many such cases are sure-fire success for the victim (defendant)? In any case, they should do as one of their phony legal companies threatened about 13 letters and 45 pages ago and put the matter before a court?0
