Serving a claim in the E&W court even with the added fee for asking permission to file to an address outside of E&W just results in your pointing out you are outside the jurisdiction, refusing to bring yourself under the jurisdiction, and filing the correct application to the court
You then claim your costs at £60 per hour as they would have no costs protection.
  • I am looking forward to the day when i can send a reply to one of these firms ( might get the chance as residing in England and visiting Scotland in March) of

    Dear sir

I refer you to the reply in Arkell v Pressdram

This is for other readers, as I'm sure you realise GD that the linked website isn't that of MCOL, rather a fee-charging agency prepared to do the work for you - for a fee.

Go to their second page 'Start Claim' and see how much it will cost to try to recover £200. Then, right at the bottom of that page in a yellow banner 'Sorry this service is currently unavailable' - I wonder why?

This isn't to say it's not possible to serve a claim in Scotland, but their Simple Procedure may just prove anything but for roboclaim processing. Time will tell ......

The site in question was the simplest to read so that's why I quoted from that. However, the Government web site provided a copy of the form N510 https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/688695/n510-eng.pdf

I agree 100% that it would be likely to be a Pyrrhic victory attempt by the PPC to pursue this in this case, but if OP just ignored paperwork from MCOL/Northampton because "you are 100% safe if you live in Scotland" then a default CCJ could arise. Luckily, OP is switched on.

However, we need to be careful not to create a situation where other OPs or MSE helpers here give a false sense of absolute security. For example, if sufficient tickets were accumulated by an OP in the same position, it might be worth a PPC trying their luck.
  • Just a wee update incase anyone was in a similar position and read this read. As of the 20th March I've heard nothing back after the LBCC back in early January. Given the frequency of letters I was recieving up until the LBCC I'm quietly confident that it has gone away - FOR NOW.

I'm presuming that the debt could get sold again and I'd have to go through the same rigmarole? (such a waste of bloody paper if nothing else!)

I'll keep the thread updated only if something else comes now. If not, presume that its yet more evidence that Scottish residents are safe, even if ticketed in England.

The debt was never sold. All the ppc do is get a friendly debt collector to write scary letters. They never sell the debt.
  • it should be noted that BW and others now have branches in scotland , and as such can issue claims from there https://beta.companieshouse.gov.uk/company/SC544779
