Landlord never gave me details to pay rent

    Is this a joint tenancy or an HMO?
    You don't need to sign anything to have a valid tenancy, but since you have not paid any rent, I doubt that a tenancy legally exists. If so, you have no rights to occupy and he can indeed ask you to leave without notice.
    If you do have a valid tenancy, then only a court order can evict you.
    Your LL of course has protected your deposit, supplied a current GSC, EPC etc? And is declaring his rental income?
    No free lunch, and no free laptop ;)

    Why don't you have it? You knew you owed it, why didn't you put the rent amount aside each month until you were advised how to pay? Simply spending the money instead was your decision, and to my mind a rather foolish one.

    The landlord has 6 years to chase you for the money.

    Worst case scenario he will take you to court and you will then have 30 days to pay or end up with a CCJ and bad credit rating.

    I suggest selling your car to pay your debt.

    The LL sounds dodgy.

    How much info does the LL have on you, OP?

    Is there a Guarantor in place, for your rent?

    Do you use your car for work?

    Yes you have been irresponsible, but saying that is like throwing the baby out after the bath water now - but you do need to learn from this.

    I was not always the shining example of adulthood that I am now, and it took a scare before I started taking bills etc seriously

    Just to add I know of a landlord, ie one of my siblings and she chased a non payer for several years - the T purposely did not pay and used the rent money to live a nice life of holidays and designer goods. Anyway, sis chased him to his parents home years down the road, the ex T had possesions worht thousands and owned sis with cost about 8k, and she got the money back having bought in high court sheriffs. Cost sister more than that and her time and worry but she said it was worth it.

    So pay up, ensure you have a receipt and move on.

    If you have no signed a contract of lease with him then maybe you do not owe him. Is there a law that you owe someone you do not have a contract with?

    Verbal contracts are valid. Proving they exist is a bit difficult but if you've been living in a property someone rents out and you have no links to that person then it isn't hard to prove a tenancy exists.

  • I would start saving for paying the rent now, incase it's asked for and because morally it's the right thing to do. if he's not contacted you within 6 years for the money then that's a nice little savings pot you can spend at that point. is there anything in writing / text / email that is akin to contract and confirms how much you should pay?

    i do think however that if your landlord is corrupt, the likelihood of him taking you to court to recoup the money probably isn't very high! i doubt he's declaring the rent if he isn't bothering to collect it, so it'll probably open a can of worms on the tax front if he starts to go down the legal route.
  • If landlord has not served you with a notice of his name and an address (in England or Wales) then no rent if due anyway.



    However, when he does provide such info all rent going back to start of tenancy becomes due.
