    Blackmail required.

    Phone your landlord and tell him that as he has failed to protect your deposit you will be suing him for 3x the deposit amount unless he agrees to end the tenancy and return your deposit in full. Make him put this in writing.

    If this fails, contact environmental health.

    How long have you been in the property? - remember the LL has a period of time in which to protect the deposit. If you try to use this as leverage the LL will simply protect it during this period (if still within) rendering your potential leverage null. That may be something to sit on until it is a definite.

    Again, the source/cause of the smell is very relevant to your options... has an ex-tenant planted a fish?

    OP, can you please confirm where this property is located: Scotland, England, Wales or Northern Ireland? Do you share any of the accommodation with your landlord or does your landlord live in the same building?

    Just to be clear, black mail is a serious offence.


    However this is a negotiation in a civil dispute; which is not black mail.
