BW Legal *newbie, have read the thread but need spoon feeding!*

I had a PCN from Britannia parking in July 2017.
I don’t even remember why now, I assume over stayed on a P&D.

I have ignored all correspondence from Britannia.
I today have received my first letter from BW legal.
It states they require full payment within 16 days. If I fail to do so they will commence legal proceedings with county court and further threaten a CCJ and how that affects my credit score.

I’ve read so much information I don’t know if I’m coming or going.
Do I continue to ignore? Do I respond with an appeal? If so what. Etc etc.

Thanks in advance!

You have come to the wrong place if you want us to spoon feed you. this is very much a "put in the hours" board.

Keep reading the stickies until they stick, it is parking, not rocket science. Read this

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.

Ignore until/unless you get a Letter Before Action (probably from BWL), you will know if it's a formal LBC as it will give you 30 days to respond, or real court papers from the Northampton CCBC distribution centre.

Read the NEWBIES FAQ sticky, post #2 which takes you from the receipt of the LBC right through to the hearing (and all points in between).

This forum doesn't offer spoon-feeding. There are only around half a dozen regular advisers, giving their time voluntarily, and typically we are dealing with 80-100 cases a day ...... and every one wants spoons placed in their mouths, makes it much easier for them of course. Not enough spoons to go around!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You aren't going to get "spoon fed" on here, especially if you don't even have this basic information!

However you are still at the debt collection stage and can't do much but ignore unless as stated above you get real court papers.

The threats of a CCJ affecting your credit score are just threats and even if they took you to court that is preventable providing you follow everything to the letter. Once again all spelled out in the newbies thread as stated.
