Initial appeal rejected.

I received 2 PCNs parking outside my house, the first was successfully appealed with UKCPM as the picture was too dark but the appeal for the second PCN was rejected.

I stated that I am a resident on the road (not of the development that use UKCPM) and have a valid parking permit. However it's difficult to see the permit in the picture and it's possible it could have slid down the side.

They have suggested I go via IAS should I wish to appeal further but I've read in the sticky that there's little point and in fact an IAS loss could embolden them.

Is having a permit despite it not being clearly visible on a dashboard sufficient defense should the wish to take me to court?

I'm not above just paying the fine to be done with it but I don't want to give them the satisfaction, not do I want to motivate the residents who are actively taking pictures of any and every car they can in the hopes they'll receive £10 from any fine that is paid.

EDIT:

I emailed the committee of the development that put up the parking signs and they say it's out of their hands and cannot get UKCPM to cancel. Is this correct? I'd assume that if a PCN was issued to one of them surely they can force CPM to cancel that?

" the committee of the development" did hire them then they can cancel .... if not ask them who did hire .....

one game / tactic to try is to ask them who will be the 'responsible person' .... as you will need holiday / commitment time for next year should this get to court, off them.

you are right ... the kangaroo court ... errm IAS is a waste of time ....

"Is having a permit despite it not being clearly visible on a dashboard sufficient defense should the wish to take me to court?"

it is certainly one item for your use of ....

"not do I want to motivate the residents who are actively taking pictures of any and every car they can in the hopes they'll receive £10 from any fine that is paid"

could be a bit of fun to be had here ... find away to put the word round about people making extra cash with out declaring it ...... I am sure there will be internet info on such ;)

while you await for any court action ... you could SAR the scammers to find what info they have on you .... in preparation ....

and have a look through the section about courts in the newbie thread ....

    anyway good luck

HSL888, is this anything to do with [URL="https://forums.moneysavingexpert.com/discussion/5934443other CPM thread[/URL] posted earlier this month?
  • it is related to that thread. apologies if I should have updated that old thread.

I contacted the council with regards to private/public status of that part of the road and whilst they couldn;t give me an exact answer, they did imply that it appears I was parking just past the point where it's considered private
