Napier - I had a ticket with evidence

I would appreciate some advice please. I was issued the standard £90 fine from Napier. I had purchased a valid ticket, when I arrived back to the car it was on the floor in the foot well of the car.
No PCN on my windscreen but received a letter stating I have been fined. I appealed with their internal procedure, with supporting pictures of my valid ticket.
Napier are only willing to reduce the fine to £20 as I still failed to display it properly according to their terms and confidtions of parking.
Where do I stand on this? I think this is completely unfair when I have a clear valid parking ticket. It’s unfortante that the wind/draft blew it on the floor.

Standard problem with these scammers, they do not provide adhesive tickets, a judge has already told one of the scammers about this when the case was dismissed
It's a last ditch attempt by Napier to scam you

Napier are members of the IPC so further appeals are futile. They are also fairly litigious.
You have two choices. You could wait and see what happens. They have 6 years to start a claim or if you are risk averse pay the £20.
Bear in mind that's the last time they will make this offer. Court will be more expensive if you lose.
The other point to consider is that their case isn't particularly strong. They wouldn't settle for £20 if it was.
I hate to say but it's your call depending on you willingness to take risk.
Try complaining to the landowner to see if they will cancel it.0 -
Well as Waamo says you have two choices; go into ignore mode, you could then be waiting for up to six years to see if they try a punt in court, but there's no guarantee that it will or wont go there .
But in that time they will probably put the invoice back up to it's maximum and have handed over to their debt collectors who will bombard you with silly letters.
A judge may or may not side with them it depends on if he is switched on to the PPC industry scam.
Or you could pay their fee of £20 which is basically covering their admin fees plus a bit of bunce on the side.
It's your call really it depends on how much puff you have for a fight, you should try the landowner route if you can it's always worth a go.
But I bet you £20 that no where in their letter does it mention the word "fine" where did you get that from?0 -

I hate to let Napier have any money out of me for this. I will contact the landlord and attempt to get this thrown out.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0
