Statute barred or not

Not sure how to start a forum....have a question about a debt and wondering if statue barred.!
Debt happened while living in England 5 years 8 months ago. I know statue barred in 6 years...but I live in Scotland where statue barred is 5 years....


So is it statue barred already or will it be 6 years since that is where the debt occurred?

    Debt is statue barred however they have said a ccj was awarded! The ccj is not showing on my credit file. The court papers were sent to my mum's old address. I never knew they were applying for a ccj.

    Because it isn't showing on my credit file....what should I do?

    The CCJ is only reported to the CRAs for six years from the date of the Judgement. After this time, the CCJ data is removed from your files. Even though the CCJ is not reported, it will still in theory, be enforceable.


    Have you got details for the CCJ (which court passed judgement) from your creditor?
    I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

    Thanks for replies....I do not know what court issued the CCJ. This is an English company and I live in Scotland so it would be interesting to see if it was a Scottish court.

    They sent the CCJ in 2016 to my mum's old address. My mum moved in 2014. I never lived at the address. I think this might be one of the reasons I can't see it on my credit profile.

    I don't work and don't own my house and baliffs don't have the same forceable entry here in Scotland so if I do have a ccj I am thinking about ignoring it until 2022.

    Further development! Company lied and said CCJ was awarded a number of years ago. However it was not showing on my credit profile. I contacted the court who apparently awarded the CCJ who said they indeed did not award a CCJ.

    The last acknowledgement and or payment was over 5 years ago. It is an English company. However I reside in Scotland where the rules of statutue barred is 5 years not 6.

    Company have said they will now be applying for a CCJ. I have sent the Statute barred document and this will be my defense in court.

    Their bold lies and scare tactics are extremely distasteful!
