Full and final issue!

Hey people!
Brace yourselves as this will be a long old post - I stress HELL in HELLix alot, because they have been a complete nightmare.

So....
Over the past year or so i have battled my debts and ended up clearing them, I payed a F&F offer i received back in august - on the basis that the account would be COMPLETELY SATISFIED , and Defaults and account closed completely, With no footprint from the debt.

The original company (Hellix) agreed to those terms, I also received the terms in writing via email.

Now my issue is as follows...Hellix should of updated Kapama LTD, that I have paid the debt, along with those terms and conditions.

Bare in mind this was august 2018..I checked my credit report today, Kapama - Outstanding balance £***.

So I equifax, explained that this was paid back in august ETC ETC, they reply with "Kapama say you still have a balance owed and have no proof that its paid.

I call HELLix, and they inform me all is fine, all updated , kapama were told on the 26th august 2018 and I should call kapama to see whats happened - So I did exactly that, Kapama LTD then came back with "Sorry Sir, there has been no correspondence from HELLix , You still owe us £***, this is where I become frustrated, The lady on the phone dug deeper, saw that I had indeed paid that outstanding balance back in AUGUST, but had no update from HELLix.

Now my question is, Due to the poor lack of service from HELLix, this has taken a huge impact against my credit file and history in general, my main priority has been to clean my file up this past year, and their lack of service has clearly impacted and jeopardised that,
due to them making such a large f**k up, is there anyway I can gain any compensation ? Perhaps get the money I so graciously paid out to them because I only had 12 hours to actually accept their offer, so I jumped at it by adding my own terms to it, and them agreeing if I pay within the 12 hours that it would be fulfilled, CLEARLY it wasn't , So can I gain compensation from them doing literally NOTHING ?

    In which case a formal written complaint would be in order, ask them to backdate the information on your credit file.

    If you remain unhappy escalate to the ICO.

    Compensation would be at the discretion of the creditor, if you don’t ask, you don’t get, possibly £100-£150 may be appropriate.

  • I agree , they’re apparently attempting to resolve it over the next 24 hours, and I’ll get in touch with the main creditor to see what can be done, £100/150 sounds fair indeed.
  • So. They’ve offered to remove the default from my file, upon digging further into my own credit file, the default automatically gets removed in 4 days time anyway.

    So I think they’re trying to ‘offer a resolution’ that is going to sort it’s self out anyway, definitely unhappy with what their offering.
  • UPDATE : Been in touch with HELLix and Kapama again today, Explained im unhappy with the resolution, reason : The default and account gets removed from my credit file within the next week automatically, so all they're offering, is basically what is going to happen within a weeks time inevitably anyway.

    So that isn't a resolution, I explained this, got some attitude from the "geezer" (this is what he addressed him self as, "I don't really know what to say, i'm just an average geezer that works here") GREAT START!

    I assume my next step would be to contact the ICO or Ombudsman ?
  • As long as your credit file is updated and the default falls off your record, and it is confirmed that you have settled this debt - is it worth the stress and hassle you are putting yourself through for what will, at best, be a paltry compensation figure.

    I would recommend just taking a deep breath and moving on.

  • What compensation did you pay them for not paying back what you borrowed?

    I can see why they have little interest in bending over backwards to help if you fidn’t honour their deal.

    Maybe they decided to do what you did, offer a deal then just decide to change their mind afterwards. That would seem fair to most people I think. Karma some call it.

    I cant understand what you think the problem is.

    On first reading, I started off thinking you meant you'd paid up the settlement, but they'd lost the record of it and might be still demanding more money

    But reading again more carefully, you say they have tracked it.

    If it drops off your credit record in a few days from now, surely that's the cleaner sheet you've been looking forward to. Forget about it.

    Compensation is supposed to be about restoring someone's losses. It isn't clear you have any. If you've failed in some credit applications recently it's most likely from the presence of the default in the first place, rather than the last few months.
