  • I have tried to be concise and not develop the arguments. In this, I have attempted to follow an example of bargepole in the Newbies thread.

    My original Defence, which I did not post, was much longer and after reading bargepole's examples cut a lot of it out with the intention of using it in the witness statement together with evidence. I agree that the conciseness of the text makes it difficult to understand all ot the nuances.
  • I know both locations. My guess is that the carpark owner has given his postal address to the PPC, as the car park is not attended, so that he/she can receive any mail directed at the car park. Hence the location on the NTK does not match where the car was parked. Just an admin error.

    There are various private parking possibilities at the 'wrong place'.
  • All going to plan. Defence updated and enhanced with the comments from the forum, defence filed and case to be held in my local court. I am working on my witness statement now.


    Can anybody help me locate a copy of the case transcript for Jolley v Carmel Limited [2000] 2 EGLR 154.? I have tried the list provided by Parking Prankster without success.

    Does anybody have any other ideas? Do I need it for the WS or is it well known by the judge and therefore not required?

    You could register for a free trial with Lexis Nexis, which makes court cases available I think (never done it myself).

  • After I had received the WS from the claimant, I issued my WS and then a couple of weeks ago I received a letter from the claimant and a copy of a Notice of Discontinuance. The letter says a copy of the Notice of Discontinuance has been sent to the court and I am now waiting for confirmation from the court. However this looks like a successful defence to me and a satisfactory result.

    For your information, my WS was 6 pages long plus 24 pages of evidence and attachments of which 12 pages came from the PoFA 2012, Schedule 4. Photos were kindly provided by the claimant and the rest of the attachments were screen shots.
