Please offer some advice as which way to go otherwise I may as well pay £185! and move on - I've already spent 2 full days reading through comments and huge amounts of info. if I knew what to do or had more experience I would offer it to people not try and score points like you seem to be.

    I am just pointing out any errors or lies in the statements you make and directing you back to the NEWBIES FAQ sticky thread where the explanations and advice are situated, plus to an almost identical thread where I gave advice to another poster and a link to a court case win

    yes its a game, you have been picked to play and all these things matter so hence the pedantry, take it or leave it , its your choice, I have spent the last 5 hours advising you (and others)

    pay a solicitor who knows about these matters and knows why I have said what I have said, the fact you dont understand them or are shown to be in the wrong is not relevant, because VCS will tear you apart in court if you dont learn from these rookie mistakes and assumptions

    this isnt a legal aid forum, its about parking charges, so you are way beyond that, you are in the small claims court which could be about not paying your plumber or decorator, or what you see on RINDER every day , not just about driving or parking or stopping on a private road

    1 day , 2 days , 20 days, whatever, its irrelevant, the time you spend on this will not be paid back even at £2 per hour, sorry to say

    so you can either accept my advice and showing you where you are incorrect (or lied), or not, its your choice to make, its free advice and its correct advice , so if you learn from it and dont make the same mistakes twice you may well win this

    we want YOU to win, but we wont do it for you and you DO need to be educated on the legal meanings of these words, because its a legal court case

    you have already had some good advice, use it

    The issue date is 07 Dec 2018.
    With a Claim Issue Date of 7th December, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Wednesday 9th January 2019 to file your Defence.

    That's four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.

  • Hi everyone, apologies if I'm posting this in the wrong place, but I'm new to this forum and can't figure out where to post my own question. In 2010 I went to a PPI reclaim company who tried to claim back my PPI from my bank how ever my bank contacted me advising me that they do not deal with third parties and I had to contact them myself if I wanted to claim back my money which I did and received my money fast forward two about 3 years ago I started receiving phone calls and letters from the claim company saying I owe them £583 I contacted them and told them as they did not claim my money back for me I would not pay them. They have since sold this debt to another company and I've now received a claim form from the County Court Business Centre and I don't know what to do can you please help.

    Phone the CCBC and tell them you made a mistake. Ask them nicely if it can be changed.
  • Phoned the court re ticking the wrong box, they said it doesn't matter and cant view the Aos? Just need to file my defence.

    Where does it say in the GDPR that a SAR should anticipate a 7-day turnaround? Did you mark your email as an official SAR Request?

    You must know from your research that they have a month to respond to a SAR...... don't you? Just baffled as to why you were expecting them to respond to a 1-week deadline just before Christmas?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
