Am I covered for theft by deception? M&S Home Insurance

Last month I sold an expensive item on EBay, which I thought I'd received payment for, but only after posting did I realise that the payment notification email I'd received was actually fake and not from PayPal.

I tried to get Royal Mail to stop the delivery but they said they couldn't intercept the mail, so it was delivered and signed for. I've reported to the police who tell me that the usual method for these scams is to use an address with a communal entrance where the scammer waits and then signs for the parcel. I've also reported this to Action Fraud.

What I'd like to know is whether I'm covered for the loss of the item on my home insurance (M&S Home Insurance). I know that some insurers specify that 'theft by deception' isn't covered, but I've read through my policy booklet and it doesn't mention this in exclusions. The only part I can find that looks like it could be used to say I wouldn't be covered is under 'Your duty to prevent loss or damage'- "You and any other person this insurance applies to must take all reasonable precautions to prevent accidents, loss or damage".

Does it look like it's worth me trying to make a claim for this?

  • Your home insurance won't cover you for posting your belongings to people.
  • I recall a very similar case when I was a household underwriter. It was for a Rolex sold on eBay.

    We didn't cover it as it wasn't stolen from the home, it was taken out of the home and willingly posted.

    I can't recall if the client went to FOS or not, if they did, they lost, as the claim was never paid.
