An update
I have received the DQ, this will be sent via email on PDF to the courts and the claimant early next week, well before the deadline.
I have received the contents from a SAR, there are is a lot of information. There are several pictures of my car parked that show the car park was light fairly well.
I know my next steps after sending the DQ off it to draft a defence, I would appreciate some guidance.0 -
You filed your Defence last month.WelshBoy77 wrote: »I know my next steps after sending the DQ off it to draft a defence, I would appreciate some guidance.
It's Witness Statement and evidence next.
As you might expect, there is ample guidance on that in post #2 of the NEWBIES thread.0 -
Links to example defences can be found in the NEWBIES FAQ sticky, post #2. Pay especial attention to the example drafted by legal expert and trusted forum contributor bargepole. Use that as your base, fit the issues relating to your ticket into it.
You are not looking for much more than one side of A4.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you KeithP and Umkmoaas.
Those posts / threads will be looked at.
To clarify the N180 needs to be returned to the relevant court and the claimant Excel Parking Services (NOT the law firm they are using - BW Legal)?0 -
Send you completed DQ to the CCBC in the same way and to the same email address that you send your Defence. See post #10 above.WelshBoy77 wrote: »To clarify the N180 needs to be returned to the relevant court and the claimant Excel Parking Services (NOT the law firm they are using - BW Legal)?
At this stage, all communication with the Claimant should be via the address given for service of documents on your Claim Form.0 -
Hello Keith P
DQ was sent to the courts CCBCAQ@justice.gov.uk
I do not understand what you mean "the address for service of documents on your claim form"? Do you mean the SAR I sent to EPS?0 -
No he means the address for service of documents to the Claimant (BW Legal's address if they are behind this claim).
Yes.To clarify the N180 needs to be returned to the relevant court
No. The claim form tells you who to send stuff to!and the claimant Excel Parking Services (NOT the law firm they are using - BW Legal)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello Keith P
I followed your advice and read those posts by Bargepole, the layout and structure I can follow. Most of the points do not apply to my case (#2,4 & 5). I think point 6 does apply after googling “promissory estoppel”.
On post #2 there is a section “At witness statement stage (usually NOT LATER THAN 14 DAYS BEFORE YOUR HEARING!) don't forget to file the evidence you will rely upon, which should at least include:
Points (a), (b) and (c) I will include. This will involve going back to the car park.
Points (d) and (e) I think are not relevant.
Points (f), (g), (h) and (i) are not relevant to my situation.
My next steps will be …
• Find the signs in the Beavis Case,
• Visit the car park to take pictures of the signs and video,
• Read the EPS response to my SAR and match up their replies to the points raised in my SAR and my defence,
I have not sent a copy of my defence to BW, would the courts do this?
Appreciate the help and support so far.0 -
Re-read post #22 above that you wrote.WelshBoy77 wrote: »I have not sent a copy of my defence to BW, would the courts do this?
