Equita

Hi - I've received a letter from Equita Limited today.

Take Formal Notice - Park with Ease LTD - outstanding parking charge and the amount is £110.00. The usual, if not paid may recommend court proceedings, could involve legal action.

It is the same as all the others I have seen on this site.

My question is:

What next? Shall I ignore and hope I don't get a letter before court?

I've never had anything from Park with Ease LTD and am unaware of when I have parked and not paid? It has a client ref, but I'm not logging into Park with Ease to enter that number in case it leaves a trail.
I'm not calling Equita either, as that will just open up a massive can of worms, from the worms themselves.

    That's about it. Nothing further to say, other than try to get the landowner to cancel it.

  • Thanks Umkomass - I dont know where it was from unfortunately as I never received an initial parking charge.

    Will update if I get another letter - court stage etc.

    PWE are quite active at car parks near nature reserves, open spaces, lakes (esp The Lake District) and the like - that might help you narrow it down.

    As an aside - Equita are debt collectors and will use trace agents to access the current address of a previously unresponsive individual. PWE would access your details from the DVLA, who use the information on your vehicle's V5C (logbook).

    Have you moved address in the past n months/years? Have you updated your V5C? Check, don't guess. This omission is the greatest reason why motorists are blissfully unaware of private parking charges being racked up against them.

  • No I havent moved, and have had my car for 4 years, so no need to change anything.

    I've been to the Lakes, but in a camper van which wasnt mine and I wasnt driving, so dont know how this could have happened. I have been to a nature reserve near Peterborough over the summer, but didnt park in the car park; ended up in a field far from anywhere. Wonder if this could be it? Although I've been here before and didnt have to pay?

    Meh - what a perlava.

    You can get to the bottom of this by issuing PWE with a Subject Access Request (SAR). No need to guess. Give them some hassle in return - nice Christmas present from you to them!

    Get your MP on the case.

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.
