County court claim but have moved abroad

Hi,

Posting on behalf of a friend who's asking me for advice based on my good outcome!

We were flat mates and both received PCNs from SIP parking.

He has now received a county court claim from Northampton from SIP themselves rather than Gladstones, for parking outside our residential bay. The trouble is, he is no longer living in this country. He has moved to Australia and has informed SIP of his new Australian address. Despite this, they have still issued a court claim to his old address.

Surely they can't do this?? Surely they cant expect him to fly back for court?? Any advice on how to respond to this claim??

    If he isn't returning to the UK for six years ignore it.

    He can give the court his new address. That would be fun. They will likely drop it as no jurisdiction.
  • Don't bother talking to the PPC anymore. Tell your friend he needs to call the court and advise them that despite repeatedly being told his new address the PPC is using his old address in an attempt to gain a CCJ by deceiving the court into thinking he is ignoring their communications. This is an abuse of process and very possibly illegal behavior.
    Never admit to being the driver, POFA 2012 Schedule 4 is your best friend, always fight as registered keeper. Disprove keeper liability and you may be able to claim/counterclaim for data protection breach(s) and harassment. Don't just fight back, FIGHT BACK.

    I would write. By all means call to tell them but follow it up with a paper trail.

    Calls are worth the paper they are written on.
