Aqua - Credit Card Fraud

Good morning,
I did do a skydive and left my personal belongings at the centre whilst I jumped. This was a line of enquiry by the credit card company. The point that I should've checked my belongings more carefully before departing the centre is valid. But I had just jumped out of an aeroplane for the first time, it genuinely didn't cross my mind. As above I only realised something was up due to receiving a notification, otherwise it would've gone unnoticed until I got home!
I don't think I was negligent with my pin, I never have written any of them down, or disclosed to friends/family.
Aqua is owned by New Day, I also have a Amazon, New Day account. I have cleared my balance like I do every month for all my credit cards. I am considering calling and closing my account, after this experience I really don't want to be dealing with this company again. Would you advise this?
I can't advise you about closing your accounts, sorry.
On the subject of checking your belongings after the jump, if they were locked in a locker, you might reasonably expect them to be in the same condition as they were when you locked them away and it would be a moot point whether failure to check at that time was somehow negligent.
If they weren't locked away...0 -
First point: contact Aqua again, say that the fraudulent transaction is in dispute and ask them to freeze interest. And there should certainly not be fees related to it, so ask for those to be removed. If they refuse then make a separate complaint about that.
Secondly, does the letter actually state that your PIN was used in the fraudulent transaction?
Thirdly, I suggest you apply for another card before cancelling your existing one.0 -
Just my two cents - when I was in New York three years ago I dropped my wallet which had my Bank of Scotland Credit Card in it. Some nice guy/woman picked it up and went on a spending spree with it (swiping the card and signing a scribbled variation of my name).
BoS became suspicious as it was hundreds upon hundreds of dollars within about half an hour to which ended up a final balance of over $1,200. It shot me right up to my limit.
Anyway, BoS refunded me within days after their fraud checks.
Worthwhile pushing harder.
If you were indeed SkyDiving, surely you'll have proof of when you were in the air and then match this up as to when the transaction/s began?
I.e. if you were in the air at 12:58 but transaction was registered 150 miles away at 1:10, surely you'll be able to use this as evidence?December 2018 (MSE Joining date)- Unsecured debt: 2018: £52k2019: 45k2020: £33k 2021: £25k2022: £19k2023: £TBC- Mortgage debt:2019: £124k2021: £118k2022: £113k2023: £TBC0 -

In those markets where signature verification is/was prevalent it is easier to pursue a claim of fraud.
Where a PIN has been used it is less easy and the bank may well be holding on to the notion that OP was negligent with their PIN and should have been more aware of the whereabouts of their card. That's why I hinted that OP might be able to expound a theory for how the PIN came to be used without them having been negligent with it and why it might not have been felt necessary to inspect their belongings if they'd been locked away during the jump.
It's up to OP whether they push it with their Issuer but, like you, I would.0 -
Just an update;
I received no reply from the outlet itself or it's stores, so I have no choice but to accompany my letter with my sent/chasing emails only.
Email from the skydive centre confirming they've CCTV but only save it for one month
My statements for all over cards, displaying a higher amount available and not abused.
My flight home from L.A & the distance in other direction from the skydive centre/outlet
I know I got shut down for my conspirator statement in my opening post, but Aqua increased my balance last week by £1500 & offered me a 6 month interest free money transfer, which I have had to use to pay the fraud balance as the interest is destroying me. I do personally find it funny that after stating I have no means of paying in one go they offer me a 0% offer and an increase that would cover the amount I don't have. I will be sending my letter tomorrow, if I have missed anything I should include in my letter or if there is a template available I would be very grateful for this before tomorrow.
Thanks again in advance0 -

But does give me a way of paying them now, which I shouldn't be held liable for in the 1st place.
It may be 0% but it is still £1,500 they have received in my opinion unfairly. Bitter pill to swallow paying someone else spending spree.0
