Link Parking & BW Legal LBCCC

I have read the FAQs & Stickies but I can not find an answer for the particular circumstance I have.

I am the registered keeper of a vehicle that is said to be - Not parked in a designated area - in Norman Road DA17. A family member, unknown to me, emailed Link Parking in September, but unfortunately has said they "acknowledge it is their car" even though they are not the registered keeper, copy below.

"I write to you in relation to the above referenced Parking Charge Notice (dated 30th August 2018) issued due to the vehicle “Not Parked in a Designated Area”.

Whilst I acknowledge this is my vehicle, I have absolutely no recollection of this occurrence and your Notice has not been supported by any photographic evidence verifying your claim. Furthermore, there was no Parking Charge Notice affixed to the windscreen of my vehicle and I only become aware of this when your Notice was received in the post. It is, therefore, my view that this Notice has been issued incorrectly or without reason unless there is satisfactory evidence to the contrary."

I have now received a letter from BW Legal asking for the cost of the PCN and a legal costs charge of £60. It says that because no payment was made or appeal raised within 28 days of the PCN they require payment in full. Followed by notice that they will seek legal proceedings in the County Court.

The email my family member sent was within this 28 days as it was sent on August 20th.

I am unsure what template I should use now.

Can somebody please give me a nudge in the right direction?

    Sorry the email was sent on 20th September, still within the 28 days.

    The right direction to read up on this is the newbies faq thread #2


    That covers court claims and lbcca.


    Till you get a lbcca or court correspondence you can ignore these debt collecting attempts (see #4 in the FAQ for advice on debt collecting letters)


    (You are dealing with an IPC company - see the FAQ #1 on why any appeal was futile, whenever it wa sent!)

    I have just sent a Subject Access Request to Link Parking. I think that is what it suggests I do in the thread. Is that right?

    It just seems so wrong not replying to the legal letter. Totally against anything I would normally do.

    When the family member sent the email, was it in their name or the registered keeper's?

    Whoever it was has certainly caused you some grief.

    Would this be an LBCCA or is it a collection attempt?

    That tells us it is not a Letter of Claim.

    It can safely be ignored.
