we dont answer the "leg to stand on" question because it is stoopid and not enough information is known
any win would be on a technicality, like no landowner contract , poor and inadequate signage , POFA2012 failures, BPA CoP failures etc, in your case it would probably be FRUSTRATION OF CONTRACT due to the ticket machine failure coupled with poor signage
and the MSE GUIDANCE is awful so wipe it from your mind and never read it again as they wont change it despite numerous requests to do so
the CORRECT guidance is in the NEWBIES FAQ sticky thread near the top of this forum, near the NEW THREAD button that you used
please read it and decide
as an aside to your question, if PE have dotted every i and crossed every t, then if they have a person as "bang to rights" then that person is probably liable, especially a keeper
they beat BARRY BEAVIS 3 times in 3 different courts 2 years ago, so your winning argument has to be better than any of his
your BEST OPTION is a landowner or M.A. cancellation, so get that done asap because they have abided by POFA2012 with timescale (8 days) and probably the NTK wording as well and I doubt that they failed the BPA CoP0
