Unfair parking ticket

Hi All,

Just looking for a bit of advice on the best way to proceed. My mother in law was given a parking ticket when parked at her friends flat. She was displaying a visitors permit, but one parking solutions gave her a ticket anyway! Do i need to appeal to one parking solutions first? Looking at their reviews it barely seems worth it, or should i go straight to POPLA?

I know not to say anything about who was driving :)

Please follow the advice in the sticky thread for NEWBIES and appeal to the PPC using the blue template you will find there.
This should be sent from The Keeper and nobody else, unedited.

PoPLA isn't available for an initial appeal.

You cannot go to PoPLA without first appealing to the PPC.

This is explained to you, along with a lot more in the stickies/FAQs which you must read in order to understand the scam which is the private parking industry.
You never know how far you can go until you go too far.
  • Thanks guys, i will wait for day 26 to come around and ask the keeper to send in an appeal to the PPC. It really riles me that we can't just send in an appeal on genuine grounds, but ah well, we will just have to take the long road to win against these scumbags!!

It is indeed a long road, but the end may be in sight.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of

The keeper and her friend need to complain to the landlord and MA/MC about this scam. The keeper's friend needs to dig out their lease/AST to see what it says about parking and visitor parking.

The keeper and friend should both separately complain to their respective MPs as well about this unregulated scam.

  • Thanks for the advice, we will look into complaining to the landlord and managing agent in the hope that a long winded appeal process can be avoided and I will ask the keeper and her friend to consider contacting their MP.

Does the photograph show no permit in place?
  • It was a windscreen ticket so there is no photographic evidence as far as i am aware. I guess we would need to contact the PPC to get it?

Check their website. You'll probably need the PCN reference number along with the vehicle's registration number to access any photographs.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
