    Yes, this all suggests that agents ought to seek their own independent legal advice before marketing a property. And take steps to ensure their client doesn't make any changes to the title while it's on the market...

    If you paid for the searches, that money has been spent and you won't get it back.
    You shouldn't have paid anything (or much) for the sols before finding this out.

    My purchase fell through on tenure grounds without a penny spent, that's why this surprises me... The tenure issue was discovered by the lender before the mortgage was approved so sols hadn't even started any work...

    Either way, there are lots of new properties being sold as leasehold, this doesn't necessarily mean that you shouldn't buy it. Have a word with your solicitor about it if you really like the property.

    I would suggest it's the seller you've been misled by, rather than the estate agent. They're the ones who provided the information in the first place.

    Is the Estate Agent a member of a professional body, like PropertyMark or RICS? If so they will have a complaints procedure and this would probably be upheld (its a glaring error after all).

    The property has been mis-described. If it is so easy to check this, why didn't the EA do it?

    Why did the vendor mis-describe the details to the EA? They should know.

    Who says they did? More likely the EA just copied and pasted and old add and forgot to change that bit.

    Who says they copied and pasted an old ad?, I believe it's most likely the vendor give the information.

    If that was a deal breaker for you, you should have made sure beforehand. You can sometimes find out for free on sites like zoopla if the property has been sold in the last 10 years or so.

    There are some leasehold properties than are 999 years with peppercorn ground rent - they are more or less free hold as even if it is halfway through the lease, you are never going to see the end of it.
