Yes, this all suggests that agents ought to seek their own independent legal advice before marketing a property. And take steps to ensure their client doesn't make any changes to the title while it's on the market...So if a buyer mentions to an agent that they are considering adding an extension on to the property, the agent now has to read the Title and look for, and interpret, any covenants that might prohibit this? And I suppose check if the property is listed or in a Conservation Area? How far down the legal investigation does an agent now need to go........?0 -
If you paid for the searches, that money has been spent and you won't get it back.
You shouldn't have paid anything (or much) for the sols before finding this out.
My purchase fell through on tenure grounds without a penny spent, that's why this surprises me... The tenure issue was discovered by the lender before the mortgage was approved so sols hadn't even started any work...
Either way, there are lots of new properties being sold as leasehold, this doesn't necessarily mean that you shouldn't buy it. Have a word with your solicitor about it if you really like the property.0 -
I would suggest it's the seller you've been misled by, rather than the estate agent. They're the ones who provided the information in the first place.All shall be well, and all shall be well, and all manner of things shall be well.

Is the Estate Agent a member of a professional body, like PropertyMark or RICS? If so they will have a complaints procedure and this would probably be upheld (its a glaring error after all).0

If that was a deal breaker for you, you should have made sure beforehand. You can sometimes find out for free on sites like zoopla if the property has been sold in the last 10 years or so.
