I have been complaining to the police and health and safety for months as this is coursing my family health problems but so far no-one has even spoken to the neighbour about his ilegal habit. Thus I was wondering what a) my legal situation is with regard to this neighbours ilegal habit and b) given that his tenent is performing an ilegal act on his prenises is the landlord liable?
The police might be interested if they thought it was being grown, are you sure its only being smoked?
Family health problems, there would be very little health effects of secondhand smoke, its perfectly legal to smoke canabisin some countries.0 -
I sympathise with you. Had to go into someone else's house the other day for work and my coat still stinks of it several days later. If you are brave maybe challenge the neighbour about it, but beware because if they smoke so much weed they will probably assume the world owes them somethingAn answer isn't spam just because you don't like it......0

Health problems could easily be the stress of constantly smelling an illegal drug in their home and worry about what other people will pick up on? I'd not want all my clothes, hair etc smelling of weed and then have to go to work... I'd not be able to have guests over either.
I agree that blocking up the gaps where the smell comes in is most likely to get you the resolution you need fastest.0 -
Contact the landlord. Local authorities will challenge their tenants regarding smoking weed in their property if they get complaints as it is stated in the tenancy agreement that it is a breach of your tenancy to allow drugs to be used in your home & private landlords should also take a similar approach, although sadly a lot don't.
I had the same issue next to me which is social housing and the council dealt with it.0 -
As above, a positive air pressure system is your best bet, one that draws air from the outside and pumps it into your house. That means any air gaps between the two houses it will always be air going from your house to his. There are two ways of dealing with any problem:
- try to persuade someone else to solve it
- solve it yourself
Solving this one therefore depends heavily on whether the OP is renting or an owner-occupier. If renting, it might be less hassle to move, as otherwise the landlord has to come on board and allow changes to the property's loft, or more. Plugging the gaps in the brickwork isn't a big job, skilled or expensive, but there's no guarantee the LL will allow or fund it.
If the OP owns, then the way to a solution is clear, without installing positive pressure ventilation in the first instance. There's always a possibility that gaps at joist ends are contributing too, and it's no fun pulling up floorboards, so in that event PPV is then the way to go.0 -

Report it again to the Police and complain if nothing happens-ask them to come to your house and see/smell for themselves-they do have powers to deal with this and should use them. You should not have to put up with this x0
