    No they can't.

    This keeps coming up on the forum.

    If the garage don't pay off the finance(they will) then the finance co chase the garage not the person that bought the car.

    My point is that they did not declare this at the time of contract. They povided false info in advert and verbally saying HPi was clean yet the HPi came up with Adverse warning. My argument is that the info they provided at the point of contract was false and I was misled. Therefore the contract is null & void?

    Am I right or am I barking up the wrong tree.


    Sorry the other issue is that they promised a top-class external warranty worth £700. But afterwards they said its their own warranty and its not underwritten by anyone.

    The HPI is clear except for their stocking finance. Since they can say for sure that will definitely not be an issue it is, to all intents and purposes, clear.


    Can you just clarify, please... Are you actively trying to find ways to get out of this deal? Or are you simply worried about the stocking finance?

    So the finance/HPI is a red herring ? You're just looking for a loophole to get out ?

    no that's right,its a stocking loan, but the principle and outcome are the same....buy from a dealer, you get good title.

    False advertising and false promises. The misrepresentation on the warranty really worried me.


    HPi-Clear as advertised but technically not HPi-Clear. Depends how a judge/registrar would look at this.


    I think the motoring industry needs to sort this out. If it does not affect the consumer, it should not show up on HPi check.

    Splitting hairs on the 'technicality' of the HPI check. It's really a non-issue. I think the OP is looking for an exit from the deal.
