Estate Agents & GDPR

We keep getting spammed by one particular estate agent who apparently has people wanting to buy in our building.

Initially they were sending letters with our names on them (taken from land registry) but when I complained they removed our details. Now we continue to receive exactly the same letters, but addressed to "Homeowner".

I've complained twice but they say they don't have to stop sending them as it's not using our personal details.

Surely if I have asked for our address to be removed, they need to stop???

In the meantime I've had the (childish) pleasure of saying when the time comes for us to sell, hell will need to freeze over before we list our flat with them.

    If childish pleasure is your thing perhaps get your own back by singing there address and email up for as much spam as you can manage?! Lol

    I suggest you read the CAB page on Harassment then write to the EA advising them that they are in breach of the Protection from Harassment Act 1997 and they should immediately cease to contact you. You'd probably have a hard job to make it stick legally but the threat may be enough to get them to stop.

    Just laugh at the money they are wasting sending you these. In London we get these nearly every day, either just cards through the door or sent through the post. The whole street is owned by a Housing Association so a total waste of their time and money.

    We get leaflets through the door from Lidl, Aldi, Ikea, local trades people, utility suppliers, political parties, etc. etc. and if we don't need their services or want to shop with them, the leaflets go in the paper recycle.

    I don't see why your EA leaflets couldn't be treated the same way.

    "The Occupier, 37 Acacia Avenue" is not personally identifying information, so does not fall under GDPR.


    If you DID manage to get them to treat you any differently to a random address with which they've never had any dealings, then they WOULD be storing personal information on you - your preference as to their marketing material...
