Completion nightmare

    Is the property empty of contents?
  • I've just read his contract and it's very standard with no special condition. Still regarding to hand the keys over though and they close in 3 minutes.

    Vendor is in breach either for not providing keys or (if in fact the solicitors are aware possession hasn't been handed over) delaying completion.
  • So he has just been given the keys but has been told the chain above are going to charge him interest for failing to complete!

    They can try... after all, he DID complete on the allotted day.
  • He was completely ready this morning. Mortgage money arrived yesterday, he transferred the additional funds at the start of the week and then Barclays online went down. How can that be his fault!? He's 23 and saved since he was 15 to get a deposit together. He doesn't have the money to pay a whole chains interest especially as he did actually complete today.

    Agents can't decide not to hand over the keys to the new owner if the new owner has completed. I personally would get a locksmith out and change the locks on the flat.


    He owns a flat that the vendor needs to empty of personal belongings either today or tomorrow. The flat no longer belongs to the vendor so he can't decide whether to let your son in or not because he doesn't have any rights over the property anymore.



    The vendor needs to get his furniture out and put it in storage.

    It isn't him who hasn't completed it is the person above him who gets charged the interest because they are the ones who haven't completed. You can''t charge interest for failing to complete if they have completed.

    The property should be empty because all of the vendors furniture and belongings should have been in the furniture van ready for completion. All the vendor had to do was to direct it to a storage unit instead of the property they haven't managed to complete on themselves.


    Once he has got the keys he should just be able to move in.



    If the flat has still got the vendor's furniture and belongings in it then I think you can assume that the vendor had no intention of completing today and this is nothing to do with your son.

    Your son is not in the wrong.
    He has completed in line with the contract. Anything above your son in the chain is not his problem - as harsh as that sounds.

    I can not see how he would be liable for any costs further up the line.

    Stressful weekend no doubt but speak to the solicitors on monday, I am sure it will be fine for your son.
