    Hi there, I am just finishing up with my defence to e-mail to the court but just wondering about one issue? In the full defence points by Coupon-Mad I noticed this wording -

    "The court is invited to note that no named Solicitor has signed the Particulars, in breach of Practice Direction 22, and rendering the statement of truth a nullity. "

    Just wondering if I should include or cut this? The court claim form has been signed by a 'Zarvin Vandrewala' and on the BWLegal website he is listed as 'the Supervising Solicitor' so even though this is clearly the robo-claim that Coupon-Mad is stating are they no longer in breach of Practice Direction 22 if they are getting their supervising solicitor to sign all the claim forms?

    I say cut the line out, if your claim is signed by a named person.

    I can honestly say I've NEVER read a post by anyone who says that BW Legal dealt with them fairly.

    "I can honestly say I've NEVER read a post by anyone who says that BW Legal dealt with them fairly."

    I made ONE phone call to BWLegal (before I read advice to never ever phone them) as their letter said to call so they could 'help me to sort things out.' The guy on the phone was actually really nice and respectful and I was pleasantly surprised. I made it quite clear I disputed the charge. However, short lived as I had given them my phone number. They proceeded to then call me or text me EVERY SINGLE DAY after that phone call!! After a week or so I had to block them as it was really upsetting me.

    So 'Abuse of Process' is the number one point here? Before unclear signage and landowner authority? Should I highlight this at the very top of my defence?

    NO.

    It's a secondary argument, just damage limitation to peg the disputed sum at £100.

    I personally think that a judge is made aware quickly of such abuse with reference to what other judges have said.

    If the judge decides it is abuse of process and strikes out the case, then everything else fails. DJ Taylor in Southampton decided on Abuse of Process before there was a hearing
