Administration Fee Advice - Agent mislead me.

Hey guys,

Just a quick one, and I apologise if you’ve seen this before! I recently went to visit a new build property as I’m looking to move house.

Whilst viewing I noticed a couple of pieces of large furniture (such as wardrobes), that would have to be removed before I could move in, there’s no space for me to have them. I ask the agent about this and she advised that the landlord is a friend and that it should be no problem.

Shortly after, whilst still at the property she advised that there was many more viewings this afternoon and already somebody waiting to pay an administration fee, but they had told him to wait as I was viewing first, and that the only way they could guarantee the property is if I paid a non-refundable administration fee - £450. I paid it with a credit card using their website. So far all of this has been verbal, no written contracts or signatures.

It’s now two days later and the letting agent has been in touch to tell me there’s no way the landlord will remove the furniture. I have an email where she acknowledges she said they could be removed, and apologises that they cannot.

Do I have any actionable path here? I’m not willing to let the property with the furniture in (I don’t have the space for it). Can I get that fee back? I could just charge back my credit card, but I assume that is unwise.

    Always get things in writing, in the contract. You have given a non refundable fee. you may lose it all.

  • Clarification if it matters at all, so far all of this was verbal, bar her email acknowledging she said the goods could be removed and apologising that they can not. No written contracts or signatures.

    When I left a holding deposit of £450 it was on the basis the property would be unfurnished as confirmed in your email dated xxx.

    As this is no longer the case I feel I have been mislead by xxx.

    Please confirm that due to the agent's error my deposit of £450 will be returned to my bank account xxxx within 7 working days
