Banking error.

On 29th August i received £1017.52 which i considered my wages, however the royal bank of scotland are now writing to me saying i was the victim of their banking error and wrongly credited with £1017.52. They "apologise for the inconvience" and want the full lump sum back in a cheque!
There was no consideration for the worry and distress their banking error caused and that annoyed me, therefore i requested the recovery was waived and sent a complaint to the Financial Ombudsman.

money is a wrongful credit and needs to be paid back
not giving back a wrongful credit is a criminal offence under the theft actYes Your Dukeiness0 -
You say you 'considered it' your wages. Does that mean you actually weren't expecting that money and knew it wasn't your wages?0

May your post be a lesson to others who have been tempted to keep money wrongly credited to their account. With respect I'm sure you would have been aware of the error but like so many others you chose to quietly spend the money and hope it would not be discovered. Also think of the stress and inconvenience it has caused the rightful owner of this money.0 -

It's incredibly common. But you are not entitled to the money, it's not yours. The Bank's mistake gives you no entitlement either.
It's best to separate out the two issues - firstly, correction of the mistake. You simply repay the money, which is not yours to keep.
Then, once that's done, request a payment from RBS as damages for the distress and inconvenience they've caused you. Difficult to quantify, but £25-50 - or maybe a bunch of flowers, bottle of wine.
You surely knew it was not your money? You had your wages as well, didn't you?Warning ..... I'm a peri-menopausal axe-wielding maniac0 -

How was the credit written on your statement?
eg BGC ABC Ltd or whatever the company you work for is called or did it just show as a Sundry credit?
How does your salary normally appear on your statement?
What made you think this was your salary and have you also received the proper amount into your account which would be your salary?
You have no leg to stand on - I don't know the type of account you have but IMO they can just debit your account with this amount forthwith and let you deal with the consequences.
How can you think of profiteering by saying that you spending someone else's money caused YOU worry and distress!!
What about the person the money was intended for?0
