ANPR is not mentioned on the BPA AOS list, so this is probably a self ticketing operation by a Tesco employee and they likely took any pictures

you need to be holding them to account, not helping them with their evidence

and you must not include any of your details on a public forum, so no VRM, no PCN number, no name and address, no PIN numbers or bank details or mums maiden name

data protection is important, and blabbing about anything at all could compromise your case

    I received an auto reply that included;

If you are appealing a Parking Charge Notice (PCN) and it is at an appeal stage it will now be put on hold until a response is sent, provided we have the following information:
    · PCN number and/or vehicle registration
    · Title, first name and last name for the driver
    · Full postal address with post code for the driver

I assume I dont take the bait here.

Disingenuous. They should not be setting conditions in order to extract the identification of the driver. The keeper should be simply 'invited' to provide the details.

Time for a complaint to the BPA (and a copy sent to the DVLA) requesting that they 'whip' their member into line and instruct them to deal correctly with your appeal. You have no intention, and there is no imperative placed on you, of ever identifying the driver to a private parking company.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Right will do. Was going to ask if this was appropriate.
    Thanks.
  • I have received a reply to my appeal.

The Operator has not included any POPLA Code with the rejection email.
They have not asked me for any new information or given any time limits within they will restart the collection process. This seems at odds with the BPA codes - section 22.

    How should i play this?
Do i start asking for the POPLA code?
Or do i wait for them to comply with the codes off their own back?
Or should I contact BPA to advise them?
Or all or some of the above?

YOU WAIT ...... ball is in their court ..... no code means a complaint to the BPA and the DVLA.

I trust this is the end of your spending trips to Tesco ?

In fairness some of the parking at this Tesco is a nightmare and I understand why they needed to take some action but this is just exploitative to the point of ridiculousness.
Yes that Tesco in particular will have no more of my money.

I have already complained to the BPA should I update them now or does that risk them advising the operator of their error and them therefore giving them the opportunity to rectify?
