Paypal debt passed to Wescot - Child's account.

Hi

My son has opened and eBay and PayPal account - he's 15. He sold a bag and then the buyer said it didn't arrive and wanted a refund. My son refunded it, but now paypal are chasing him for more money and have passed the debt to Wescot. It's not much money, only £17, but i'm wondering about the legality of this as he's under 18. I think he must have said he was older to open the account??

    From the Paypal T&Cs that he was presented with when opening the account:

    To be eligible for our Services, you must (i) be a resident of one of the countries listed on the PayPal Worldwide page; (ii) have full legal capacity to enter into a contract; and (iii) if you are an individual, be at least 18 years old

    so unfortunately he has committed fraud. As he is a minor I think you need to contact PayPal and try and sort it out for him.

    Calling it fraud, is a tad excessive, in the event that the terms and conditions cannot be fulfilled by your son, because of his age, all that will happen is the agreement will become void, as you must be 18 to enter into a contract, and the account will be closed.


    He will not be liable for the debt either.

    I suggest to avoid this escalating any further, he fesses up to PayPal about his age, they will call off wescot, he will lose the account, but that will be the end of it.
