An Unknown Default

Hi there,
Really after some advice.
My partner was applying for credit and found they had a default payment on their credit score. Now they had looked at their score already the day before and it wasn’t there, only showed up the day after for some reason despite having been there since 2016.
The main issue is it’s a final payment from a contract he ended with 3 mobile while starting a new one (he finished a WiFi contract and started a phone contract). It was all done with them, they had his address, email and phone number and he never heard anything about this tiny final payment of £36, that was all it was for! Now several years later they are saying the payment was due they did send a letter so it’s not on them and nothing can be done but surely to god something can!
They didn’t give him anything, they say they sent a letter but none came and it’s such a small amount had he known he’d have paid it! And not to mention they could have called or emailed anytime to inform him!
I need help, please give advice!

I am not sure what to say other than I think you should settle the outstanding amount. If you owe it and it's not a mistake on their part then the best way to fix this is to pay the remaining balance. It will look better on the credit file if it is settled. That is if you definitely owe it.
You can put a complaint in to the relevant department about lack of communication on their behalf about the outstanding balance. If they have not closed the account they should be able to prove the letter that was sent out or any emails sent. They are meant to notify you and send out a debt collection letter. So they should have the debt collection agency associated with the account on record. But if it is from 2016, the likelihood of getting that information is slim.
Did your partner have a previous address with the mobile contract in question? A previous address may have just been linked with the credit file, which may explain the sudden appearance?0 -
They had the correct address at the time and we never received anything.
The balance has already been paid obviously, he paid it as soon as he saw it. The issue was that it was left to go default because they never gave us and proper notice of the debt, and even if they had the incorrect address he’s had the same number and email for 8 years.0 -
If they weren't updated with the current postal address then it's not their job to go hunting people down.0

Why do you not complain to 3? Surely they must hold your partners addresses (and previous account addresses) on their records? Have you complained that they have not cross-referenced the dates that they hold on record as your partner's addresses? That, I think, is was you need to check....I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

They say they wrote to him and you can't dispute that.
Pay the bill and ask them nicely to remove the default
They don't have to because he did owe the money and failed to pay. They don't have to call or e-mail. They sent a letter whether you received it or not.Non me fac calcitrare tuum culi0 -
Ive had 2 defaults from three removed. Complaint via resolver, then if they don't respond escalate to the ombudsman and their executive support team. That's what I did anyway0

So you’ve followed the complaints process and raised an official complaint and waited the 8 weeks required and asked for a deadlock letter so you can escalate it to the Ombudsman?
