I don’t know what to do :(

Hi, so recently I have been on a ticket resale site (which at the time I didn’t know) and the rugby tickets I bought for my grandad, supposedly were for the 29th. The next day I realise I wasn’t on the rugby website and so I checked the real website and it had no game on the 29th following this I had already paid for the tickets so I emailed Viagogo enquiring and they said they got it muddled up it’s on the 28th. Now this is my issue, because I had already paid. They won’t give me a refund and I can’t make the 28th. So I have paid for tickets for a game that doesn’t exist then given different tickets on a different day, and I have to pay for them even tho I can’t make the day. Surely this is in breach of some sort of law. Because I feel robbed of £150 :(:(

    Your post is really confusing. Did you buy tickets that said 29th and are actually for the 28th or was it a mistake on your part?

    To be honest it's a bit academic you've bought off touts who pay very little heed to the laws anyway.

    Can you not sell the tickets?

    Maybe at a loss, but with the idea that something is better than nothing.

    1.3 Viagogo guarantee - You will receive the tickets you paid for... which would be the 29th, this is impossible because there isn't a game that day.

    2.4 Listing - As part of the listing process, the Seller assigns a price to the tickets and provides information including but not limited to the event, date, section, seat, and row, and sale end date - You have purchased the 29th which is not available

    2.6 - Making an offer - Once the Buyer finds a matching ticket, the Buyer notifies Us with an "offer" that the Buyer is willing to purchase the ticket. - Your offer was for tickets on 29th

    2.11 - Ticket fulfillment - Once the Seller lists tickets for sale, the Buyer purchases these tickets, and the Seller has confirmed the sale, the Seller is responsible for completing the transaction with the exact tickets the Seller has listed. - 'Exact - 29th'

    2.15 Claims under the viagogo guarantee information

    Read through this page, there is so much on here that confirms that inaccurate listing means you should get a refund. Alternatively, are you able to go back to your card issuer, because the goods are not as described?

    Are you saying there's a rugby game on the 28th however not the one you want to attend?

    As you have proof they have said this then, I agree with @nbinblack where Viagogo guarantee confirms that an inaccurate listing means you should get a refund. When you go back to them and they're still refusing, hopefully you paid with a credit card because being over £100 Section 75 is on your side. (Credit card issuer acts as the middle man so that's who your 'contract' is with).

    At the end of the day, it's not really a refund you seek but a change of date, if I've read correctly. Perhaps mentioning that again (they've already confessed they messed up the date), you just may get issued the correctly dated ticket
    So I have paid for tickets for a game that doesn’t exist then given different tickets on a different day,
    A game does exist just not for the date you wish. Either way, go back and see if willing to correct their error and sell you the intended ticket. :)

    How can they buy the intended ticket? The op though they were attending a game on the 29th, the listing said 29th but it should have said 28th. They don't want a change of date as they can't make the 28th.

    They can't then be sold a ticket for the 29th as there is no game on that day

    Oh dear.

    I am aware that UK Trading Standards have called Viagago one of the worst companies, if not the worst.

    However I think you still have a claim here, since it was their mistake. They are not a fraudulent company and are subject to terms/conditions and guarantees.

    If they are proving that reluctant to pay out and you are not willing to pursue it then I can only advise you to resell the tickets.

    Unfortunately, since Viagago have hefty premiums, I don't think you will get all your money back. On social media you could sell them for face value, but I could be wrong and someone out there would pay the full amount.

    If you have lost a lot of money here, I would read their policies thoroughly on refunds and quote their own policy in your complaint.

    In future, I can only suggest that you use the ticketmaster app when on a countdown for tickets and wish you the best of luck. Or any other reputable site, that doesn't charge premiums. Don't use touts.

    Also, if you have a screenshot or any kind of correspondence of the false date advertised by Viagago that would add a hell of a lot more weight to your complaint.
