PCN/bwlegal

On 2nd June 2016 I parked in Crossways car park in Paignton Devon. Paid for my ticket, had to type in my reg no. Unbeknown to me the ticket machine did not display the first letter of my reg but it still gave me a ticket. I paid for 2 hours but only used 1 hour. 2 weeks later I received a pcn fine for £60 which I appealed against as I had no idea the machine had not printed the ticket properly. I appealed twice and both times was declined. I refused to pay it as, strangely enough, even though the car park was saying I was parking illegally , the company was still able to send me a fine so they knew my registration. I have today, 5th Dec 2018 received a letter from Premier Parking Solutions stating they have passed my account onto BWLegal . Enclosed is another letter from bwlegal requesting immediate payment of £160 or court proceedings maybe issued. They also threatened ccj’s . They are requesting I contact them immediately to stop these proceedings. I feel very strongly about this and have spoken to many people who have also had fines for the same. Do I need to be worried about this and should I actually pay this fine, much to my disgust?

    there was no "fine", just an INVOICE

    IGNORE b w legal for now but send a SAR to the DPO at PPS to get all their evidence etc

    NO YOU DO NOT PAY THEM and at this point you don't even contact them.

    BWLegal are trying to extort money from you, the extra £60 is a fake

    The 2008 Regulations make misleading actions unlawful
    (see regulation 5). An action by a trader is misleading if it
    contains false information or if it is likely to mislead
    the average consumer in its overall presentation.

    Consumer payments and “civil recovery”
    The Regulations amend the definition of a “transactional decision”
    to expressly cover demands for payment from a consumer in full
    or partial settlement of the consumer’s liabilities or purported
    liabilities to the trader (see reg 2(1A) of the 2008 Regulations).
    This means that misleading and aggressive practices in respect of
    such demands would now clearly lead to both criminal sanctions
    (under the 2008 Regulations)


    If so, there is a case to be investigated by Trading Standards

    This letter must prove their case against you, pictures of car and
    signs etc, their costs.
