Private Parking Appeal not acknowledged

Hi,


I have 2 private parking PCN’s received by post.

1st from PPS (PCN Issued 4th September. I sent appeal on 21st September by email. I have now received a Final notice 4th Oct)

2nd from Euro Car Parks (PCN issued 27th July. I sent appeal letter on 16th August and have now received final notice dated 29th Oct)

I followed the newbie post and sent out the template appeal for BPA members to both. However they both don’t seem to have acknowledged my appeal and havent sent me any POPLA number to appeal.

What would be the next course of action please? What should I write to them?

    Copy to BPA and complain to your MP

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    I’m desperate for a template to appeal a parking eye parking charge on the grounds of the plural grace period ( driver overstayed 17 minutes in a shopping retail park but the car park is a nightmare to get parked in AND to exit, often heavily congested and it was a Saturday afternoon! )
    Any help greatly appreciated! Xx

  • @The Deep, thanks. I will issue another letter to Euro Car Parks.

    With regards to PPS. The car was parked in a Tesco Carpark disabled bay.

    In the parking appeal sent to PPS It was mentioned “In order to resolve the dispute, I attach a copy of Blue Badge for an occupant of the car.”

    However they came back with the response below.

    BPA Code of Practice explains that when a vehicle is parked in a private car park, the normal rule is that the DRIVER is responsible for paying the tariff fee (if any) for parking, for following the terms and conditions which apply, and for paying any parking charges.
    If you wish to give the details about the driver (name and current address for postal service) we will transfer the liability for the PCN, otherwise we will be able to pursue the registered keeper under Schedule 4 of the POFA act 2012.”

    They sent that reply via email on 27th Sept!
    So i should go ahead now as i havent recieved any popla code and write to the BPA?


    Any help on the content of letter to BPA would be great please.

    Just to clarify I should write to the BPA to complain against PPS for not providing a POPLA code?

    Also for Euro Car Parks they have sent a Debt Recovery letter through now!!! and increased amount to 135! and given a deadline to pay by 17th December. Im worried and thinking to just pay. They have threatened with court action and quoted below.

    "Supreme Court decision about parking charges
    You've probably heard people say that parking charges aren't lawful...However in Nov 2015 a parking operator took a motorist to court for a parking charge - and won. The supreme court ruled that the parking charge was lawful. the ruling is seen as an important 'test case' for parking operators."

    Yes. You've been advised what to do I really don't understand why you are questioning it?

    Complain in your own words. There is no template as it needs to be personal. People copy templates blindly and if one is posted up people will misuse it.
