I have read the newbie thread but I'm getting a bit confused.
I pay monthly, by cash to a takeaway for a parking space on private land managed by UKPS (they keep a record of all my details including registration details etc). I receive a pass which I display on my dash.
On 25th Sept, when I got back to my car I had discovered a PCN on my windscreen and noticed that the pass had slipped down the dash and was barely visible. The reason for the PCN issue was no valid permit clearly on display.
I decided to appeal, and sent it off on about day 22 - it was about a week before the deadline. I did not hear anything until a NTK was delivered by TNC Parking Services requesting £100 payment in full. Because my husband is the registered keeper, he opened the letter which was dated 7th November.
I contacted TNC but they wouldn't speak to me about my case, but when I explained my issue said that it was my fault for not making sure that the pass was on display. I contacted UKPS about my appeal and they said it was out of time and that they had received it on 26th October. For that reason they told me that I had no further appeal rights and that I had to pursue with TNC.
I was absolutely about to pay the £100, because I'm worried about my husbands credit even though everything I'm reading would suggest his credit file would not be affected. BUT it's so not fair - I shouldn't have to pay it!
My question is: What do I do next? Is it right that I do not have a right to appeal? Should my husband send TNC a letter to say he wants to dispute it as he was not the driver? Or should I not do anything, because after all it's an invoice and not a fine?
Any help would be appreciated (And I'm sorry if I should have got my answer from the newbie site)

It is not a penalty notice.
The keeper has a right to appeal, but there isn't one worth trying when an IPC member is involved.
The best option is to get the landowner to cancel this.
Failing that, cancel the monthly payment, park elsewhere, and tell the landowner why.
Please confirm the name of the PC as there are at least two with the same initials.
Debt collectors can of course be safely ignored. You are now in ignore mode unless you get real court papers.
Please also complain to your MP about this unregulated scam.
Remember, it is quite possible that a person or persons unknown bounced up and down on the car to dislodge the permit with malice aforethought.I married my cousin. I had to...I don't have a sister.

TNC are a nasty debt collector , do NOT ring write or talk to them , they have no say in what has happened .
a letter correctly addressed and sent by first class is deemed to be delivered within 2 working days
I am surprised UKPS are using the services of TNC
1: please confirm this is the correct company https://www.theukps.com/
2: as the takeaway hired those clowns they are there masters , ask them to
a: get this ticket cancelled (they can)
b: have your car VRN added to the white list of VRN at the site so that muppet and Co do not add more tickets

Has the driver been formally identified to the parking company in writing? Yes or No.
If not, the responsibility for dealing with this lies with the registered keeper. The RK has protection under the Protection of Freedoms Act 2012; the driver has no such protection.
You are suggesting the driver might want to appeal, rather than the RK. What grounds would the driver appeal on that would be better than those put forward by the RK?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It is not a penalty nor is it a fine, it is an invoice for alleged damages under Contract Law for an alleged breach of an alleged contract, it is a scam. If this takeaway has a website, or Facebook page, write bad stuff on it. Also complain to your MP.
It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

They told me that they have sent quite a few of these out and told me to ignore them 100%.
No the driver (me) hasn't formally identified to TNC. I contacted them and they wouldn't speak to me because I'm not the registered keeper, it's my husband. Does my husband just ignore this?

Hi,
My husband the registered keeper sent an email to TNC with the content of the first appeal letter on 7th Dec. He today received another letter for outstanding parking charges dated 5th December requesting payment of £160 because they had not had a reply within 28 days.
What are my next steps? Do I resent the original email so refer to the latest letter and back it up with a written letter?0 -
its an IPC member so no appeal possible or worth doing with UKPS
I would IGNORE everything EXCEPT an LBC or an MCOL within 6 years, do not IGNORE either of those, but IGNORE the begging letters from debt colLectors in the meantime0
